Default Any CA FFLs getting notice of distributors no longer shipping to CA due to Prop 65?

I got an email from a distributor last week about needing to put prop65 warnings on products and web listings. Now another distributor said it is suspending all sales to CA dealers on 8/21/18 until further notice.

I'm wondering if it is a temporary halt of sales until warning updates can be made.

I just got a Email From Zander's. I tried looking at the prop 65 website and the best I can figure out is, The warning labels have been changed from "may cause cancer" to specifying the exact chemical that is contained that does cause cancer. What a **** show.

does anyone have any other insight? And what other wholesalers have you heard from?

rsr is updating thier ftp files to add the warning. davidsons sent something out but i did not read it. no info from my other 7 or so distributors

Got the Zander's email today also. Bummer. They were pretty good and better prices than Davidson's. Will start hunting for another distributer. In the meantime, Davidson's will ship with 48 hr delays. Not bad.

You can try hicks (not bill hicks), will shoot, lew horton, mge. I rarely use them since I am tiered up at other distributors and they all need business so they might relax the requirements.

I received some email notifications about new warnings and disclaimers, but that's about it. Nobody has indicated that they'll no longer do business here.

In college I took a Biology of Cancer class which had guest speakers, one of which was a doctor who I later saw interviewed on TV as he was well know. Based on what he said in the class, I am waiting for produce being marked with the Prop. 65 warnings. There are two aspects to cancer, a mutagen and promoter (I think I got those terms correct) and things like broccoli are mutagens.

The email I got from Zanders just said they are suspending and don't have an ETA on when it will be lifted....guessing they are just getting set up to be 65 compliant.

I can't imagine any distributor being like its not worth it....especially right now in this industry.

I got the same thing from Zanders (temporary halt in sales) and Davidson's (48 hour delay). I made an order through Lipseys and they didn't say anything about any CA restrictions.

I do a fair amount of Gunbroker transfers. I wonder if this will be one more reason for Gunbroker sellers to not sell to CA residents.

I have not read the Prop 65 amendments so I don't know who the new requirements apply to.

I don't know why zanders can't fix it. Even lesliepool.com has the prop 65 warnings already on the website.

RSR website is down. Probably updating for prop 65.

This prop 65 stuff is out of control. I ordered some supplies for my machine shop yesterday, and got a call today from a salesmen. He said he had to to call and inform me of some prop 65 things before he could complete entering the order. One, the cobalt drill bit I ordered contained Cobalt, a chemical know to California to cause cancer. Second, the twisted metal handle of a nylon bottle brush contained nickle, a chemical known to california to cause cancer. What a waste of everybodys time.

Yes the new Prop65 regulations are ridiculous. They now require different text depending on if the chemical causes cancer, or reproductive harm, or either cancer or reproductive harm, must list at least one specific chemical from the list of 850+ chemicals currently on the list, contain a warning symbol, the text "WARNING" in bold, a font size that is no smaller than the rest of the fonts on the packaging, etc...

It is even more difficult for a website as each product page also has to have the correct Prop65 warning on it. How is a retailer that offers thousands of products from hundreds of different manufacturers to keep up with this? If you just have a product in the store in the original packaging, you are pretty much in the clear as it is up to the mfg to have the warning on the packaging, but if you take a product out of the packaging, a firearm for instance, and put it on the wall or case, you are suppose to provide the warning alongside the product. The penalties can be up to $2500 per offense, per day. Now the Prop65 "enforcers" can just look at websites and find violations. I can see them specifically targeting firearm dealers as they are hostile to us as it is in the state.

Oh, and they made these changes because they were trying to make the regulations less burdensome. One good change they made is that if you get a notice of non-compliance you have 60 days to correct it before they could actually try to fine you.

We received a letter from Christensen Arms the other day that notifies us that pretty much any firearm they make that contains stainless steel, aluminum, composite materials, or Cerakote needs a Prop65 warning for Nickel, Titanium Dioxide, Cumene, or Ethylbenzene.

I just noticed today that Fender has P65 warnings on their web site for their guitars.

Was just at Oakley looking at RX glasses and every shelf had a 65 warning but were specific to that ingrediant was in them and the potential outcome.

What is the issue with aluminum? I couldn't find aluminum on the list on the prop 65 website

Vance Outdoors and Sportsman's Outdoor Superstore won't ship to California due to Prop 65. I tried going through an intermediate FFL in Az but they still would not ship if billing address is in Ca.

You misunderstood. The source supplier (SOSS) would not ship to the middle man as long as my billing address was Ca.

Then you pay the middleman and the middleman orders and pays the source supplier, which is what I think that they were getting at.

With a FFL? The main issue with a straw purchase is filling out the 4473, which dealers don't do. Often when you buy a firearm from a dealer, they buy it from someone else, who buys it from the manufacturer.

So, in summary, no.

So what is everyone doing at their stores to comply with this. I was thinking about amending my customer agreement that everyone signs to have this sort of warning listed somehow.

We use RSR, Big Rock, Ellet Bros and Davidsons and thus far none of them have said they are out and out refusing to ship to CA due to prop 65.

We did receive an email from Glock last week saying we needed to put up signage in the case with the Glock pistols and put tags on each individual pistol with a prop 65 warning on them. I guess eventually Glock is going to ship all their pistols to CA with warnings on the cases but we are still supposed to have tags on them to be in compliance with them as dealers.

We also put signage throughout the rest of the gun room with Prop 65 warnings on them.

MGE declined to do business with us recently due to prop 65. Stated that once the manufacturers start placing the correct california compliant nomenclature on the product they will adjust policy.

Sad times folks...
