Does this mean that I can apply for a permit at anytime? How does this process work?

Argh. No, California is not a shall issue state at this time. The defendant has said they'll ask for an en banc hearing, and the judge has put his decision on hold.

While this is a great step forward for our 2nd Amendment rights, NOTHING CHANGES today. Or tomorrow. Not until the Appeals Court decides whether to grant the en banc, and if they do then it'll be months before that hearing is held. If we win the en banc, then we may still have to sue individual Sheriffs to bring them into line with the ruling, and you can be sure that some Sheriffs will drag their feet in implementing any changes to their discriminatory "good cause" interpretations.

If I wanted to apply or even get the required documents ready to apply to SCC is there an informational link other than the one in the first post of this thread that appears dead?

I realize the decision is probably on hold but i'm too excited to not start looking at what I need to do...

The first post's link is the best for now, but I can almost guarantee that there will be changes to the process and forms before SCC is shall issue and you can apply. (I wish I could also almost guarantee that there will be a different Sheriff in office, too, but I'm not as sure about that one. )

For now we'll just have to wait and see. SCC is going to be one of those counties that will hold out as long as they can.

I'm curious to see how the ruling will affect extra requirements like having to carry insurance, or even the registering of specific weapons on the permit.

that and the ruling did not mention GMC at all.
further, it may yet be seen that the ruling will be suspended pending en banc... we'll see.

I plan to send my application certified, return receipt to our overlord smith. And, I've already been looking into the new candidates.

As far as I'm aware, the Santa Clara County Sheriff's office will not even accept your application. While the desk clerk may take it because he doesn't know any better, it isn't going anywhere. They just let it sit and rot without even looking at it. I have done this twice last year. After a few weeks I contacted the office and I was asked to come and pick up my un-reviewed application. The reason provided is that the Sheriff is not currently accepting applications. Yes, this is in violation of State law, but WTH are you going to do about it other than file a lawsuit or vote for someone else???

Please let us know if you are having a different experience with Sheriff Smith's office.

I dropped them off personally at the Sheriff's HQ. I'm telling you though, they refuse to even look at them! They will just sit there indefinitely with no action until you call. I assumed you just drop it off with the clerk. I was a little confused because the application is on SJPD's site but I couldn't find anything related to CCW on SCCS.

Santa Clara county does not have a web link for CCW info! If you want to play the game, download the standard CA application from the CGF website, fill it out, and take it to the Sheriff HQ. Have fun, cause that's all you'll get out of it. For now, at least!

I used to have a copy of the Santa Clara app, the primary point was the marksmanship test and related material...

for which I went to a local range once and tested myself using the rules, and then found myself yelled at for firing too fast...

may try to dig it up.

I wonder if there's some federal law that requires a sheriff to do thier job. I know the FBI will go after LEA/LEO's who break the law, violate civil rights under the color of authority. If enough people apply and get told to eff off in violation of state law and denied their constitutional rights to exercise their second amendment, the FBI would have to do something. It's her personal policy, she's the one who's responsible and in my mind has no right to wear any badge since she's violated the oath.

a sheriff's office derives their authority from the county that derives theirs from the state...
and what you are looking for is a charge of malfeasance and/or non-feasance (yes, that's a legitimate term, see https://en.wikipedia.org/wiki/New_Ro...io#Dissolution), which is a very serious charge, and would require the State AG to prosecute. Good luck.

No, wasn't him. I did get the card of the desk sergeant who took it but see no value in naming him here. He is just another pawn in Laurie Smith's game.

I also forgot to add that I submitted twice. The first time in person the second time via certified mail. I wanted to be sure I had a record of their receipt and subsequent ignoring of my applications. Both times, I waited a while and contacted the Sheriff's department. Both times I was directed to the Public Information Officer who very kindly told me the Sheriff was not accepting applications and would I please come pick my paperwork up.

Oh, there is more. The ever courteous PIO called me back and left a voicemail which I diligently saved. In his message, he openly acknowledged that I had legitimate good cause and to call back in a few months once the Sheriff resumed accepting applications. This was in 2012. I continued to call throughout 2013 and was given varying stories from the department as to why applications were still not being accepted.

SOB's and LIARS all of them. The only way to get movement from the illustrious Laurie Smith is to sue her.

Thanks for the heads up!

I'm wondering if that case will prolong Smith changing her policy given today's news that SD will not appeal.

I won't be holding my breath that SC Co. will be even accepting applications now if they weren't before.

I dunno... if SD isn't going to appeal Peruta, that makes the Scocca suit have a generally obvious outcome.. Don't even need a 14th amendment claim..

Mind you, I missed the announcement re SD/Peruta.

Just to clarify, 'obvious outcome' means "I expect that plaintiff's counsel now can file a new MSJ, and you can expect it to be granted"

Ironic, eh? In the so-called center of the tech universe... just sayin...

I'm waiting with bated breath to see how this plays out for our area... this battle is far from over for those of us with residence in the "wrong places".
