Yeah and I think that the FFL is the one who is responsible for forwarding this info to law enforcement. If I am correct this would be EXTREMELY difficult and EXPENSIVE to implement and maintain.

Legislature returns from recess on Aug 15.

Last day to report a bill out of fiscal committees (as Appropriations is), to the floor, is Aug 26. Last day to pass any bill is September 9. (Remember the stop-the-clock trick - if desired, September 9 can last a long time!)

Bills can come off the suspense file pretty much any time; a bill isn't reliably dead until the end of the second year of a 2-year session.

However, politically, the Department of Finance is closely associated with Governor Brown. Their opposition means that Mr. Brown has given this the thumbs down. Score another one for supposedly anti-gun Jerry Brown!

While it's good to know that Jerry may not like AB809, it won't hurt to call the members of the senate appropriations committee. They have set the hearing date for 8/25, that's this thursday.

Got a tweet from the CRPA yesterday that this had failed by one vote yesterday morning but that they were going to bring it up again in the afternoon. I just checked the CRPA and they don't list anything else.

Has anyone heard anything?

I don't know how this is going to pan out. Christ my old
rifles have sat in the safe for at least five years without
me pullin en out. I'd HATE to think I'd have to reg old guns
that have done nothing but sit there because some two
bit legislature member has decided they're a threat to
society. I don't get it..

But I DO KNOW THIS..Dems are a danger not only to me
2nd rights, but my paycheck as well. They simply suck.

The bill is stupid, but not that stupid. The registration happens only on transfers and for people moving into the state.

Default What a pain!

I read AB 809 all 60+ pages in legalese. I may have missed it, but does it require registration of rifles/shotguns (firearms as stated in the bill) purchased prior to the enactment and enforcement of the bill Jan 1, 2014?

My impression was that it would apply to newly purchased/transferred firearms only. After that, once a "book" of DROS was filled it would then become permanent record for a period of 5 years and then destroyed. So while not at all good for gun owners, the "long gun registry" is in the end temporary still?

What a waste of time, money, and an invasion of privacy! I guess watch out for the serious gun grab before the first five years of the law has passed.

Man this sucks. It's like a traffic accident. On the one hand, I strongly resent this legislation, but part of me wants to see what happens to the price/availability of long guns in California between now and Jan 1, 2014. Just out of pure morbid curiosity

So...when do we find out whether we should be fine with begrudgingly voting for Jerry or not? haha.

ETA:

"California does not have a pocket veto.
During session, the governor must sign or veto legislation within 12 days of the day of transmittal, or it becomes law without signature.
Also, the governor has until September 30 to sign or veto legislation in his/her possession on the day legislature adjourns (usually August 31), or legislation becomes law without signature"

ETA2: Since the last day of session was today, he has until October 9th...

The times are in the constitution - we're in 10(b) because we're in the first year of the 2011-2012 session.

in the possession of the Governor after that date, that is not
returned within 30 days after that date
becomes a statute.

(2) Any bill passed by the Legislature before September 1 of the
second calendar year of the biennium
of the legislative session and
in the possession of the Governor on or after September 1 that is not
returned on or before September 30 of that year becomes a statute.
(3) Any other bill presented to the Governor that is not returned
within 12 days becomes a statute.
(4) If the Legislature by adjournment of a special session
prevents the return of a bill with the veto message, the bill becomes
a statute unless the Governor vetoes the bill within 12 days after
it is presented by depositing it and the veto message in the office
of the Secretary of State.
(5) If the 12th day of the period within which the Governor is
required to perform an act pursuant to paragraph (3) or (4) of this
subdivision is a Saturday, Sunday, or holiday, the period is extended
to the next day that is not a Saturday, Sunday, or holiday.

(c) Any bill introduced during the first year of the biennium of
the legislative session that has not been passed by the house of
origin by January 31 of the second calendar year of the biennium may
no longer be acted on by the house. No bill may be passed by either
house on or after September 1 of an even-numbered year except
statutes calling elections, statutes providing for tax levies or
appropriations for the usual current expenses of the State, and
urgency statutes, and bills passed after being vetoed by the
Governor.

(d) The Legislature may not present any bill to the Governor after
November 15 of the second calendar year of the biennium of the
legislative session.

(e) The Governor may reduce or eliminate one or more items of
appropriation while approving other portions of a bill. The Governor
shall append to the bill a statement of the items reduced or
eliminated with the reasons for the action. The Governor shall
transmit to the house originating the bill a copy of the statement
and reasons. Items reduced or eliminated shall be separately
reconsidered and may be passed over the Governor's veto in the same
manner as bills.

(f) (1) If, following the enactment of the budget bill for the
2004-05 fiscal year or any subsequent fiscal year, the Governor
determines that, for that fiscal year, General Fund revenues will
decline substantially below the estimate of General Fund revenues
upon which the budget bill for that fiscal year, as enacted, was
based, or General Fund expenditures will increase substantially above
that estimate of General Fund revenues, or both, the Governor may
issue a proclamation declaring a fiscal emergency and shall thereupon
cause the Legislature to assemble in special session for this
purpose. The proclamation shall identify the nature of the fiscal
emergency and shall be submitted by the Governor to the Legislature,
accompanied by proposed legislation to address the fiscal emergency.
(2) If the Legislature fails to pass and send to the Governor a
bill or bills to address the fiscal emergency by the 45th day
following the issuance of the proclamation, the Legislature may not
act on any other bill, nor may the Legislature adjourn for a joint
recess, until that bill or those bills have been passed and sent to
the Governor.
(3) A bill addressing the fiscal emergency declared pursuant to
this section shall contain a statement to that effect.

Contact the governor! This bill also makes it illegal for an 03 ffl to import curios and relics without a coe from the doj, and requires them to report a personal firearm import and pay a fee.

Stupidest bill in a long time.

So now that this has passed, when does it kick in? I'm predicting a surge in long gun sales...

Edit: I just read in another thread "SB 809 will only take effect on January 1, 2014." Is this indeed true?

Sorry for ignorance..when is the effective date? Can I still buy long guns now before it goes into affect or is it already affective after signature??

January 1, 2014.

And you will still be able to buy long guns then.

Bill status has been changed to 'Chaptered' - that is, it's law.

Just so I'm tracking....

When you purchase a handgun, all the information is included in the DROS and kept with the state (ATF?). When you purchase a 'long-gun' no serial # or type is listed with the state, and then the DROS paperwork is destroyed after 5 days (so basically, you long-gun doesn't exist).

With AB 809, it makes long-guns the same as hand guns, correct?

Yes. After 1/1/2014 Long Gun serial numbers will also be sent with the DROS and then retained by CA DOJ in your AFS records - just like handguns.

NO, you will not have to register long guns you already own.

YES, the DROS process will be changed so long gun information - make, model, serial number (if any) will be collected, and sent to CA-DOJ, and that information will be kept available. PC 28160

YES, intrafamilial long gun transfers are affected - there will be new or modified forms, and you will have to send them in with a fee when you transfer long guns among parent/child/grandchild. PC 27870

YES, if you move here in 2014 and later, you must report long guns within 60 days of bringing them into the state; there will be new or modified forms, and you will have to send them in with a fee. PC 17000, 27560

YES, out of state C&R long gun purchases are affected; starting in 2014 a C&R licensee must report out of state long gun purchases. There will be new or modified forms, and you will have to send them in with a fee. PC 27565

YES, in-state C&R long gun purchases are affected;
(1) Starting in 2014, long guns 50 years old and older must be transferred through an FFL; the exemption that is in the law now, that allows FTF of these, is repealed in 2014. PC 27965
(2) Starting in 2014, a buyer who is a C&R licensee inside CA, with COE (Certificate of Eligibility), may buy guns without involving another FFL. The purchase must be reported; there will be new or modified forms, and you will have to send them in with a fee. PC 27966

Default Sounds more like money grubbing than gun control

Ok noticing that all these provisions seem to incurr some sort of "fee" this seems to be more a flaky attempt at revenue by CA than anything else.
This is right up ther with CA's outrageous vehicle registration fees and "mandatory" emmisions fees and i dont see to many folks lining up to gripe about those.
As for registering firearms imported from out of state if you move here, well guess that is just contingent on how punctual you about moving your firearms..lol.

There is a similar law in HI and when stationed there and law abiding citizen I am drove down to the police station and got more flack for doing it than anything alse. Doubt this provision will be taken very seriously by law enforcement. San Diego county already mandates registering with the sheriff when you move here and no one cam knocking on my door when I moved here.
