Default Separate Upper/lower - Shipping separately

Can an out of state dealer merely separate the Upper from the Lower and ship the latter to an FFL, and the former to your house?

AFAIK...

If it's a FFL dealer, then no.
Because it would not match what's in their bound book.
(Inventory shows Title 1 Rifle + shipping shows Title 1 Other = discrepancy during BATFE audit, which can lead to loss of FFL).

If it's a non-FFL, then yes.
The non-FFL can disassemble the firearm, ship the receiver (part with the serial numbers & manufacturer's info) to your FFL dealer, and ship the rest of the parts directly to you.

So the out-of-state FFL must keep the rifle intact and either Maglock it or make it featureless before shipping to a CA FFL?

Yes.

However, it's up to their policy if they are willing to make it CA legal (fixed magazine or featureless) prior to shipping.
^Some dealers will, most will not.

I've had out of state FFLs disassemble a rifle and then ship the non-controlled parts to me, including the compliance parts. The only thing that went to the receiving FFL was a stripped receiver.

That's good to know. I expressed my concerns with the OOS FFL and he said there was no problem. I'm being cautious for now

I would appreciate some detail as to why you believe this to be so. The ATF only cares about the serialized part, so I believe this to be a non-issue. Thanks.
