Default Out-of-State Selling Off-Roster Handgun to Type 01 FFL

Hi everyone,

Iím new to the forum and live up in Oregon. Iím hoping someone can confirm for me that an out-of-State private party seller can sell an off-roster handgun to a California Type 01 FFL for their inventory.

Everything Iíve researched and heard from the FFL Iím dealing with, and family that is Cali LEO says itís not a problem.

An 03FFL is a C&R FFL and is for collectors. The only firearms which it can be used for are C&R firearms. C&R firearms are exempt from the certified list. A C&R FFL really doesn't have an "inventory", it is their collection as they can not engage in the business of buying and selling firearms.

CA law requires that all C&R firearms be shipped to a CA firearms dealer. A C&R FFL can go outside of CA and acquire C&R firearms and then come back and fill out the CA DOJ regarding the firearm.

So you would need to specify what exactly the firearm is in order to determine whether a non-exempt person (ie. LEO) can acquire the firearm.

So sorry, he’s an 01 FFL (fixed the post) and it is a Walther PPQ 9mm.

As long as the firearm isn't considered a so-called a-salt weapon, off-roster firearms can be shipped to a CA FFL for inventory, but it can only be transferred to someone who is exempt from the certified list.

Okay, that is what I understood from my research, but I am new to California gun laws. I just wanted to make sure I understood the process and did my due diligence! I want to make sure everything is on the up and up.

Thank you for the responses and for pointing out my error in the Type! My sincere apology for messing that up initially.

You're in Oregon and the only Federal laws cover how it must be sent. Let the FFL in California worry about the California laws.
