Default Will 9th Circuit wait for NSSF vs CA Decision???

What does everyone think? With the 9th circuit wait for a decision in the NSSF vs CA Microstamping case, before deciding the Pena handgun roster case?

Whether the microstamping requirement is subject to judicial review is the issue being argued to the Supreme Court in NSSF, and it is also an issue (but not the only issue) in Pena. Federal courts are bound by decision of the State's highest court determining issues of state law. Since the issue in NSSF should be decided by midsummer, and since the federal courts of appeals are never in any kind of a hurry or under ay sort of a deadline, it makes sense for the Pena panel to wait.
