As an armed citizen and having some experience with criminals, I would be very careful and thoughtful about when to introduce a gun into a situation. Since I can't predict how a car burglar will react to my challenge, I would be very conservative in my actions. Introducing a firearm to the situation can also be dangerous to me.
The criminal may also be armed and may react irrationally, violently and unpredictably to my challenge. Stepping out with a gun would be a decision I would weigh very carefully. As much as it is frustrating to watch a car get broken into, I would rather give a great description to 911 of what is taking place from a position of concealment and not tip off the burglar to the fact that the cops are (hopefully) on the way. A great book on use of a firearm for self defense is The Law of Self Defense by lawyer Andrew Branca. He does a masterful job in layman's terms of how to incorporate all the legal implications of defending yourself into your own personal action plans and response to self defense situations. The whole crowbar incident.
You do have the right to use reason able force to detain the subject, this tactically may not be the Smartest choice. However If at anytime the crowbar is raised and an attempt to strike you. Deadly force would be justified. HOWEVER, Be prepared to articulate this incident in a California Court as You are likely to be scrutinized for Your Actions. So with that being said Think before You act and Be prepared for the out come of Your Decisions. |
