Armed Burglar Sues Homeowner For Shooting
Did you see this one in the news today?
I would expect it will be dismissed but what gets me is the criminal can force the homeowner to spend thousands defending an unmeritorious lawsuit. I know stand your ground laws provide protection in other states. Is there any similar protection in California? |

I don't know about an immunity.
However, most people have homeowners insurance, which should provide an attorney for the defense of the case. Unless there is a specific exception in the policy for such an occurrence, excluding coverage. But even then, they may decide it is wiser to defend you, rather than have you sue the insurance company. Read your homeowners policy. dc |

If you watched the video of the homeowner, he indicated that he emptied his weapon at the assailant, fearing that he would be overpowered and killed with his own handgun. Three of the five rounds met their mark. I think in this struggle, this might have been the best outcome as the homeowner was already injured. (Though, I wonder what happened to the crooks gun...)
The story tells me two things; 1. You should wear it even if you are just hanging out at home. 2. A home defense weapon is not a magic wand that eliminates enemies on contact.

I think the perp has a case. the vic even admitted the perp was begging for his life before he shot him.
I'm not saying it's right, just making a point that people need to keep their mouth SHUT after a shooting. Lawyer up folks.... |

I'd like to see whatever lawyer is representing that scumbag get forced to pay the defendant's fees. It boggles my mind how this can happen, especially in a case where a man who was shot in the face during a home invasion returned fire, there is no clearer threat to your life than that.

I remember many years ago (1980's) when I had a carry permit. The instructor told us if we killed or wounded someone, be prepared for a lawsuit from the perp or the perp's family. I remember a case where I lived then....A guy was trying to get away from the cops on a bycycle and rode of a 10 ft drop and broke some of his body parts. Then he tried to sue the cops. It was thrown out of court.
