Periodically, any posts that are no longer necessary or relevant, or that don't follow the above rules, will be cleared out - don't take it personally, I clear out even many of my own posts.


Basic Overview of the Legislative Process:
  • 2018 is the second year of the two-year 2017/18 legislative session. See this thread for the 2017 year.
  • The last day for the legislature to introduce new bills is 2/16. However, any bill can be, and often is, "amended" (partially or entirely) all the way until 8/31.
  • For a bill to become law, it must be passed by both legislative Houses: the 40-member Senate (25 Democrats, 14 Republicans, 1 vacancy) and the 80-member Assembly (55 Democrats, 25 Republicans).
  • Most bills require over 50% vote ("majority") for passage, but certain bills (especially those with tax implications or urgency clauses) require 55% or 66.7% ("super-majority") in both Houses. A 66.7% vote in both Houses is also required for a bill to be eligible for veto-overriding (however the CA legislature virtually never uses that ability - it's been over 40 years since the last time they did).
  • In the House of the bill's origin, before it is eligible for a floor vote, gun-related bills are typically assigned to two Committees, where they can be amended, passed through, or failed.
  • Committee compositions are decided by each House's leadership shortly before the start of each two-year session.
  • Firearm-related bills are typically assigned to one or both of the committees listed below, but in some cases depending on the content of the bill, may be assigned to neither, or other committees.
    Typical Senate Committees: The 7-member Public Safety Committee "SPSC" (5 Democrats, 2 Republicans), and the 7-member Appropriations Committee "SAC" (5 Democrats, 2 Republicans).
    Typical Assembly Committees: The 7-member Public Safety Committee "APSC" (5 Democrats, 2 Republicans) and the 17-member Appropriations Committee "AAC" (12 Democrats, 5 Republicans).
  • If the committees pass the bill by 5/25, it goes to a House floor vote where it must be passed by 6/1.
  • "Carryover" bills (bills which neither passed nor failed in 2017) must be passed by their house of origin committees by 1/19, and their floor by 1/31, instead of the usual 5/26 and 6/2 deadlines.
  • The bill then goes to the other House, where that House's committees must pass the bill by 8/17, after which that House floor must pass the bill by 8/31.
  • If the second House amended the bill at all, then it must have a concurrence vote in the House of origin, also by 8/31.
  • Passed bills are sent to the governor, who has until 9/30 to issue a veto. If not vetoed, the bill becomes law as of the Governor's signing or 10/1 (whichever comes first), and takes effect on 1/1/2019 by default, or later if otherwise specified, or immediately if the bill has an urgency clause.

  • 14 Pro-2a - 2 passed, 12 failed
  • 14 Neutral/Undetermined - 6 passed, 8 failed
  • 16 Anti-2a - 4 passed, 12 failed

Important info about this list:
  • The bills start on Post #3. They are sorted by their progression through the Legislature.
  • Note that each bill's floor vote history on this page is written as (Y-N-X, %). Y = "aye", N = "no", X = "present, but not voting" (functionally the same as a "no" vote).
  • The % is the number of "aye" votes out of the total number of members present for the vote. Each bill requires "Aye" votes from over 50% (majority) of members present, unless noted otherwise in the bill's description.

What can we do?

It's easy to forget that the legislature is NOT a blind and deaf, self-governing entity. They were hired by us, and they work for us. They get their ideas for bills from people like you and me, and they hear input from their constituents before they vote. Re-election is nearly always priority #1, and if they are facing overwhelming opposition to their ideas or votes, they will change if they want to keep their jobs.


Proposing an idea for a new bill.

This can be done year-round, but it is perhaps most effective to propose bill ideas during the time between legislative sessions, which is roughly Mid-September through the end of the year. February 16th is the deadline for a legislator to introduce a new bill for that year.

If you do not know who your local Senator and Assembly member are, you can quickly find them here: http://findyourrep.legislature.ca.gov/.

Carefully craft your idea for the bill into a friendly and brief letter, including supporting arguments, and send it to your Senator and/or Assembly member. It may even be worth trying to schedule a phone call or face-to-face meeting with your representative to discuss your idea. You do not need to worry about the precise language for your bill idea - your representative is a lawmaker, so that part is their job.

With a little luck, hopefully your representative likes your idea and introduces a bill for it. If they don't, then thank them for their time and move on, don't harass them about it. They can only introduce so many bills per session and yours may not have fit into their overall legislative plan for the year, or they might simply disagree with your idea - in either case, you may want to submit your ideas to Representatives from other districts.


Voicing your support/concern about an existing bill.

If you want to make your voice be heard, the "what, where, who, and how" all depend on where a particular bill currently stands - making the wrong move at the wrong time or to the wrong people will cause your argument to fall on deaf ears. For example, contacting a Senator about a bill that is in the Assembly would be a misuse of both your and their time. As would contacting the Governor about a bill that is still in policy committee, and so on. The exception to that rule is that it is always a good time to contact a bill's author(s) to either thank them or express your concerns, as they have the ability to amend or withdraw a bill at any time, in any House or committee, before it reaches the Governor.

Each bill in this list shows its current location, and who you should be contacting right now to voice your opinions.

For bills in Committee, the hearings are public events that you can attend in person, to voice your support or concerns. Look at each bill's status page on the Legislature website to find out if a committee hearing for the bill is scheduled (be aware that they often don't have time to discuss every scheduled bill on a given day, so it might get pushed to another day). You may also contact the Committee members online, by mail, or by phone. Committees can amend bills as well, so feel free to propose any ideas for amendments that you may have.

Contact your district representative online, by mail, or by phone, for bills that have passed committee and are ready for a Floor vote.

Contact the Governor's office for bills that have passed both Houses of the legislature.


An important note about contacting our elected officials.

Be polite and courteous when you contact Representatives or the Governor. Whether they are Democrat or Republican should not affect what you say to them.

Nobody likes to be yelled at, belittled, insulted, or harassed. YOU wouldn't be receptive to that, and neither will they. Courtesy can mean the difference between your message being heard or ignored.


A reminder about watching what you say on public forums.

DO NOT discuss shortcomings, potential loopholes, etc., in ANY anti-2a bills until after (if) the Governor signs or vetoes it, or 10/1. And in the case of any bills for which agency regulations will need to be written after the law passes, please also continue to avoid discussions of loopholes, shortcomings, etc., until after those regulations are published.

It is well-known that the information posted in these forums often gets back to the legislature, and it absolutely can affect (and probably has affected) the content of anti-2a bills in ways that hurt us.

Treat these forums as if they are "open letters to the legislature", because they basically are.

And when a bill is riddled with errors, problems, or omissions, sometimes silence is the best course of action for us to take - let the bill fail on its own merits.

  • Summary: A gutted-and-amended bill from 2017, which was previously a bill about student physical examinations. Last year, those with certain outstanding arrest warrants became prohibited persons, requiring those people to relinquish their firearms. This bill would allow those people to transfer their firearms to an FFL, to avoid confiscation. Amended to now include the language Portantino removed from another bill of his earlier this year, requiring DOJ inspections of FFLs every 3 years. Amended again to remove the dealer inspection language, now it requires new CA residents to apply for a DOJ serial number for any home-built firearms that they are importing into the state within 60 days.

WHy isn't:
*AB-3064 (Felon in possession of firearm)* - Proving that the left doesn't actually care whatsoever about reducing crime, this bill failed In APSC (2-5), and is probably now dead but may still be re-considered before the deadline.


Publicized more by NRA/CRPA/etc.. Same with the law Brown vetoed that would have made it felony if you have a stolen firearm < $1000 (or was it $950) in value..

If they are on a committee, they represent all of California; their actions on laws affect the whole state, not just their districts.

SB-1177 Firearms: transfers (Portantino)

Gut-and-amend to limit all firearms purchases to 1 per 30 days.

ETA: This bill has a carve-out for hunters with a valid license, which was presumably why Gov. Brown vetoed the previous incarnation of 1:30 for long guns. Additionally, after re-reading this bill, another facet is that it world consider all purchases of stripped or 100% lowers as "handguns" for the purposes of enforcing 1:30 unless transferred as a complete long gun. This would mean that several of the listed exceptions to the bill would not apply to serialized lowers, and the bill would only allow one lower to be transferred every 30 days unless the transferee is exempt.

The bill is currently in Assby. Appropriations as of today.

The Legislature has now adjourned from its 2017/2018 session.

Brown has not signed anything new since the last update, and all remaining bills were passed to the Governor's desk. None have died since the last update.

Brown is now sitting on a stack of 13 bills awaiting his signature - he has until 9/30 to veto or sign them or they become law on 10/1.

He did sign AB2151, which you don't have listed as Pro-Gun (it's youth hunting-oriented)...specifically reducing tag costs:

Correct, I thought about including that bill in this list, but ultimately decided not to because it doesn't involve guns or gun rights (though it does relate to a hobby that incidentally many gun enthusiasts enjoy).

There was also another bill which would have created a combined fishing/hunting "sportsman" license for a reduced fee of $85 (versus the current $96 price to buy them individually), and it was almost completely unopposed in the legislature (it passed in the Senate 39-0), but despite that very positive activity in the legislature it ultimately it died in Assembly committee for some unknown reason. Hopefully it makes an appearance again next year.

AB 1927 ("This bill would require the Department of Justice to study options for allowing a person to register himself or herself on a list or database that prohibits the person from being able to purchase a firearm. ")

His veto message for 2888 basically says that all of those people can already request a GVRO through LE channels, and that LE and close family are the only people who are properly situated to make these decisions that have a huge impact.

His veto message for 1927 basically says, unsurprisingly, that this is a worthless bill and they can already do that research if they wanted to, without a legislative mandate.

Brown didn't provide any message with his signature for these, he just quietly signed them. I believe his signing of these 3 bills isn't very surprising to anyone. Thankfully all 3 of them have very little impact on most gun owners.

8 bills remain on his desk, including 1 that would prohibit gun sales to people under 21, and another that would apply the 1-in-30-days rule to all transfers (a bill which Brown has vetoed on at least one other occasion in the past, saying "While well-intentioned, I believe this bill would have the effect of burdening lawful citizens who wish to sell certain firearms that they no longer need. Given California's stringent laws restricting gun ownership. I do not believe this additional restriction is necessary.").

Thanks Wizard. I'll update that when I'm back on my computer soon.

That concludes the 2018 legislative session.

The only substantial change is that now 21 is the minimum age for all gun purchases. Otherwise, 2018 didn't bring us anything very substantial. Thank God.

Special thank you to all of those who wrote and called your legislators and the governor, without you guys doing your part this could have been a much, much worse year. Cheers everyone

Finally updated the thread to reflect the final updates.

There were 44 gun-related bills in 2018:
  • 14 Pro-2a - 2 passed, 12 failed
  • 14 Neutral/Undetermined - 6 passed, 8 failed
  • 16 Anti-2a - 4 passed, 12 failed

Thanks again to everyone who helped contribute information to this thread, and to those who contacted the legislature and Governor this year. Because of your help, 75% of the harmful bills failed, and 2 helpful bills passed!

See you guys in January, for the first legislative session under whoever our next Governor will be. Vote in November!
