Default need reasonable FFL for private party transfer

buying a 1911 back from a friend i sold it to. he has moved out of state. checked with manuf. to be extra sure the gun is still an approved model for CA.
places ive talked to want 100.00 and up plus DROS. hoping to find someone for less. any help? im in san jose ca

That's odd... I'm not sure where you live buy I've only ever paid 10 bucks plus DROS for PPT's. Also, if you're buying from a private party, it doesn't matter if it's on the approved list or not.

I just got off the phone with Rob from RMB Enterprises. Hes in Milpitas.

He says all you need to do is have the seller fill out a DROS worksheet and send it up with the gun. Just have them download the form from online. He charges $65. Off roster or not.

If seller is still resident of ca might work if not cannot be off roster and try uig imports for ffl. How does rmb verify id and have seller thumbprint and sign form if ppt Belongs in ffl r handgun section. OP said nothing about 1911. Could be remington rand, ithaca. etc C & R

To answer your actual question.. check gunbroker's FFL search. Search by zip code. Listings will show local FFLs and their respective fees. Link here: http://www.gunbroker.com/ffl/searchforffl.aspx

The seller is out of state. This is not a PPT, there will be no DROS worksheet sent with the pistol.

This is a dealer transfer. Fee can be anything the dealer wants to charge. Lots of expense involved shipping a handgun. If another dealer ships it they need DOJ approval first, using CFLC.

And you better be 100% sure this is still on roster, and still in the roster config. Hopefully it is *a lot* cheaper than just buying a brand new one, otherwise when it is said and done you may pay just as much.

Farwest Photography in Santa Clara has the best rates and service. Dave has helped me out tremendously this past year from PPTs to internet sale transfers.

Out of state sale is completely different. Make sure your 1911 is on roster. If it is not, and your friend ships it in, the FFL will have to confiscate it.

thanks for replys everyone. too bad some is conflicting info lol. yes this exact model is currently on the list, it would have to be shipped from out of state to me. i understand he would go to a local ffl there and ship to an ffl here. ive been getting quotes of 100.00 plus dros. it would still be worth it as it would be slightly cheaper than just buying a brand new one but more than that , this one has sentimental value to me anyway. i will try the places recomended here. thanks... oh and very sorry if i posted this in wrong place. thanks again for all the help.

yeah problem is the shipping is gonna be around $80.00, then the ffl has to charge sales tax, dros, and his transfer fee, which will run around another 120.00. the gun is definitely on list so thats not an issue. it just seems criminal that i have to pay 200.00 to bring the gun in through CA red tape.

What are you talking about?

The BATF says that non-FFLs don't need a copy of a FFL and furthermore they say it is best to not give a copy of a FFL to a nonlicensee. There is no requirement that a copy of the FFL be in the box. If a private party is shipping it, there is no authorization other than to ask if the FFL will accept a firearm from a non-FFL. If a FFL is shipping it, then the FFL needs to get a CFLC. FFLs can ship USPS, which is much cheaper since it is not the expensive UPS/FedEx overnight shipping.

If you learned all this from the former FFL that you worked out, it is understandable why they are long gone.

The seller should check to see what a FFL will charge to ship it since shipping it USPS is much cheaper (USPS regional boxes are also an option, which sometimes is cheaper, but you have to order them from the USPS web site, but it is free for the boxes). The flat rate boxes can be around $20-$25, depending on insurance, so if the FFL does not charge too much, it can be cheaper.

The CA BOE changed there view a while back since before sales between private parties out of state were not subject to sales tax. That does seem criminal since the law did not change.

Not at all possible, he seems to have serious personal issues. The last time he had a thing about the post count, as if that means anything, plus I have been on CG longer than him. It seemed like he was jealous or something.

He seems to be dysfunctional for some reason. Perhaps he was wrong and I called him on it, but he is not important enough to pay attention as to why, but he sure seems to feel the need to post stupid stuff. I am trying to help the OP and he has to trash the thread.

+1 on Dave @ Farwest Photography. $50 + DROS.

Your friend can ship it directly, no need to have an FFL do it for him. I'm surprised at $80 though.


If he includes a statement that he's an occasional seller you might not have to pay tax - not sure on that.

If it is coming from out of state, the it would be subject to sales tax unless it was a C&R occasional sale with the buyer having a C&R FFL or if it was a gift due to the change of
view of the CA BOE.

I will never buy another Spikes Tactical item, as I have a 5.45 marked barrel from them with a 5.56 bore that keyholed at 25 yards, and they wouldn't replace it.

Since the law changed. I would have to look at the date, but I think it was the same time that each long gun had to have a DROS submitted. 01-Jan-2015 is when 27585 changed. See also 27565.

ive been looking through the penal codes and its confusing but i dont see where it says i cant buy a C&R rifle from someone out of state and have it shipped directly to me as long as i have a 03 lic., a COE and report the transaction afterwards. i looked at 27545, 27966, 27585 and 27565 amongst a couple others. i dont want to break the law here so i hope some one can point me to the code that makes it illegal if it is and if not to reassure me that ill be ok lol
