Can an out of state dealer merely separate the Upper from the Lower and ship the latter to an FFL, and the former to your house?

If it's a FFL dealer, then no. Because it would not match what's in their bound book. (Inventory shows Title 1 Rifle + shipping shows Title 1 Other = discrepancy during BATFE audit, which can lead to loss of FFL). If it's a non-FFL, then yes. The non-FFL can disassemble the firearm, ship the receiver (part with the serial numbers & manufacturer's info) to your FFL dealer, and ship the rest of the parts directly to you. |

I've had out of state FFLs disassemble a rifle and then ship the non-controlled parts to me, including the compliance parts. The only thing that went to the receiving FFL was a stripped receiver.

As a follow up; I confirmed with the ATF during an inspection that there is no prohibition of this.
