Default Legal Extended Mags for XD 40 subcompact?

I have a XD 40S&W subcompact pistol and it came with a 12 rd magazine with an grip extension thus making it so there is no gap between bottom of pistol grip and magazine. Are there any 10 round magazines that can accomplish this or is it legal to place a block within the 12 rd extension mag to make it a 10 rd mag? While it does come with a 9 rd mag it doesn't offer the same ergonomics as the extension mag.

The standard 10rd magazine they make will work fine with this:

The same sleeve works with the 10rd and 12 rd mags.

XD does make 10 rd max versions of their longer mag with the grip extensions.

In fact, the Cali versions of their sub compacts come with a short flush mag (4.75") & an extra mag (5.5") with the grip extension.
