Default How to find out if you can own a gun

My brother wants to hunt with me but he was arrested and charged with a felony about 4 years ago. He plead guilty to a misdemeanor and he's afraid he can't own a gun. He's learned his lesson and has stayed out of trouble ever since. How can we go about find out if he can own a gun. I figured I'd try to help him out because he's afraid to try to buy a gun and maybe be arrested. Any info would be helpful. Thank You, Daniel

What was he convicted of?

There is a form to fill out on the CAL DOJ website to check and see if you are able to own a firearm.

There is a form available from the CA DOJ he can fill out called a "Personal Firearms Eligibility Check Application available here: http://www.ag.ca.gov/firearms/forms/

Fill out and follow directions

I think it was a drug charge with a gun enhancement, but it was a single shot 12g that i had him hold for me while I was in the military.

Oh and thanks for the doj info i printed it off for him just now. Where can he get his thumbprint of "fingerprint identification quality"

A drug charge with a gun enhancement is not a misdemeanor.

Fill out the form, or go try to buy a gun. The latter is easier as there are times your allowed "to possess a firearm", but not allowed "to purchase a firearm" and just sometimes the DOJ form will say your good to buy, but you could still get denied at DROS time. With 90-120 days wait (and $20) what's the worst that can happen? Shop says no?

If he pled guilty to a misdemeanor drug and gun charge then he should be okay if that's the only thing in his background. I think the only misdemeanor conviction that can prevent you from owning a gun is domestic violence convictions. Check with DOJ just to make sure.

My cousin had the same misdemeanor drug & gun charge 12 years ago but I think he was a minor then. It's been over 10 years so I think he is good to go. Although he doesn't want to pay full price for a home defense hand gun from an FFL and would rather save $$ by risking buying from the streets of Richmond. Some people just never learn.

It was a misdemeanor and I just talked to him and he believes he can't own a gun and he won't fill out the forms from doj because he say's quote" I'm not filling that out because I know I can't own a gun". I think he might be bipolar because last week he wasn't sure and wanted to know. Oh well his loss thank you guys for the information.

It doesn't matter what he was charged with. The only thing that matters is the conviction charge.

If he plead to a Misd. he should not be a prohibited person. If it was a domestic violence charge he plead to he is screwed.
