This looks like a regulation ripe to fall:

California State Parks rules and regulations

4313. Weapons and Traps.
No person shall carry, possess, or discharge across, in or into any portion of any unit any weapon, firearm, box and arrow, trap, net, or device capable of injuring, or killing any person or animal, or capturing any animal, or damaging any public or private property, except where the Department of Parks and Recreation finds that it is in its best interests. Nothing herein contained shall be construed in derogation of the use of weapons permitted by law or regulation and to be used for hunting in a unit, or portion thereof, open to hunting. Firearms not having a cartridge in any portion of the mechanism, traps, nets, bows and arrows, other unloaded weapons or devices may be possessed within temporary lodging or mechanical mode of conveyance when such implements are rendered temporarily inoperable or are packed, cased, or stored in a manner that will prevent their ready use.
So Not only do the Police and all LEO have NO OBLIGATION for my protection I'm no allowed to protect myself, even against nature. They make a crime "any and all devices capable of injuring or killing any person or animal..." meaning just about anything that can be uesd as a blunt instrument is against regulation.

Who writes this crap?

I guess the Department of Parks and Recreation finds that it is in it's best interests to violate both my state and national rights to carry... and wouldn't a state park regardless of location be in "unincorporated territory" making it OK for Loaded open carry?

IANAL, but I would think that this is going to help change it.

Since CA state parks doesn't equal national parks, the above change in policy plus a Nordyke win should seal the deal.

Unless the specific country prohibits it, and many do. Every time I go to any of the Santa Clara county ones I am promptly reminded that I live in the evil empire. It doesn't get any more blatant than having no weapons notices directly above mountain lion warnings--that is just how screwed up this place is.

Are you serious? I knew about federal parks, but thought I heard state parks didn't allow it. I'm going to go to Konocti Harbor near Clear Lake on 1/1/09 to go shooting with some friends and family and I had just assumed LOC was the only option. Heck, i might try out my new belly band and CCW a little! I'd love to see a citation if there is one.

so that appears to only allow cops and ccw holders..not regular visitors wishing to cc. or did i read that wrong.

Correct.

I'm talking about Open Carry either loaded in unincorporated or unloaded anywhere 1,000 feet from a school in incorporated parts of the city.

As an example; The Santa Monica Mountains includes bike trails from the valley to the beach. They happen to be part of Topanga State Park, within the Santa Monica Mountain Conservancy. As I understand it this is all in unincorporated Los Angeles City and County. Wouldn't it then be perfectly legal to Open Carry a loaded gun? as it is in other unincorporated areas?

Ok, I and many friends and some family will be headed to Boggs Mountain Demonstration State Forest on 1/1/09. We're going to shoot, and shoot lots. We'll be LOCing (150yds from any dwelling or road) handguns and carrying longguns up to designated shooting areas and such.

After reading CCR 4313 I'm confused since it contradicts what I thought I read from the BMDF sight that they allow shooting for hunting and targets.

But then, about ccr 4313, I'm noticing this wording and wondering what it means? What's a "unit?"

in or into any portion of any unit

Does that mean a dwelling? A unit of parkland?

Also, if anyone knows, please tell me if there's any new laws beginning 1/1/09 that I should know about in state parks like this. Also, has anyone been up there? It's just West of Middletown, CA near Clear Lake.

I believe that Los Angeles County has local ordinances that prohibit loaded OC in unincorporated areas unless you are in a place where it is legal for you to discharge your weapon (such as the areas open for hunting).

CA PC 12031 already says exactly what you say above.
Loaded OC in unincorporated territory is illegal where you are prohibited by law from disharging a firearm.

What does that have to do with State Parks? At least I hope you're not going shooting in a State Park.

"City" means "INCORPORATED as a municipal corporation".

"UNincorporated" means territory that is NOT within the boundaries of a City (ie, solely County jurisdiction).

City = incorporated.

Incorporated = City.

Every crime witness who doesn't have a CCW (and can't get one) needs to tell the cops and prosecutors to "go to hell, I won't testify".

Tell the judges you won't testify and tell them why.

If enough people did this, the system *might* take notice and rethink its unConstitutional, un-American victim disarmament policies.

Boggs Mtn. is not part of the CA State Parks, it is owned by Cal Fire (formerly CA Division of Forestry), CCR 4313 doesn't apply.

A div. in CA state parks is essentially each park or park management district where multiple parks are under one managing ranger.

Unless you are a peace officer or hold a valid California CCW do not bring a firearm into any California State Park under any circumstance. State Park peace officers (aka Rangers) will seize your firearm(s) and you'll more than likely be arrested. I'm close to several SPPO's and the department's stance, as per the CCR, on possessing / carrying firearms is pretty clear. I can't think of a single place owned or managed by DPR where firearms or shooting is okay.

A park unit is the smallest division of a larger park management district as noted in #23 above. In Marin County, Mt. Tam SP, Samuel P. Taylor SP and China Camp SP are all park units within the larger Marin district.

One time a few years back I took my Crossman pellet pistol with me camping on Mt. Diablo, a state park. Rangers came into our camp and saw the butt of the gun sticking out of my backpack. They freaked out over me having a weapon, detained us for about an hour, and then kicked us out of the park. Funny thing is they were willing to give me back my pellet gun as we were leaving.
