Default C&R handgun which form to use?

COE useless because of new system?


OK here's the backstory. Today I went to meet up with another calgunner to do a PPT of a C&R handgun. I am the buyer and have both a C&R and COE. As you may well know, this *should* enable me to take home the gun today.

Unfortunately it appears the new DROS system is not set up to do this. Under the normal PPT screen the only exemptions listed are Police Officer with Department letter or "special weapons permit". No COE. The store even went so far as to call the DOJ DROS hotline. They told the store that unfortunately the new system does not allow you to enter the C&R and COE combination.

Ugh, so frustrating. now I gotta do a 10 day wait even though the law says I should be exempt. What use is the COE then?

I had exactly the same situation today, bought a C&R handgun via PPT and there was no way to select the C&R + COE exemption.
So is it a bug in the system or is it a new law?

You could ask them to run it as a standard C&R shipped transfer and only charge you the PPT fees which is legit. The dealer would log it in their A&D book the same, there just wouldn't be an area for the seller to sign as if they had shipped the pistol. I bet that's what DOJ expects you to do if you were transferring the C&R Pistols via PPT.

Well, here's the official CA Penal code info:

26970. (a) The waiting period described in Section 26815 does not
apply to the sale, delivery, loan, or transfer of a firearm if all of
the following conditions are satisfied:
(1) The firearm is a curio or relic, as defined in Section 478.11
of Title 27 of the Code of Federal Regulations, or its successor.
(2) The sale, delivery, loan, or transfer is made by a dealer.
(3) The sale, delivery, loan, or transfer is made to a person who
is licensed as a collector
pursuant to Chapter 44 (commencing with
Section 921) of Title 18 of the United States Code and the
regulations issued pursuant thereto.
(4) The licensed collector has a current certificate of
eligibility
issued by the Department of Justice pursuant to Section
26710.
(b) On the date that the sale, delivery, or transfer is made, the
dealer delivering the firearm shall transmit to the Department of
Justice an electronic or telephonic report of the transaction as is
indicated in Section 28160 or 28165.

It does not specify whether it only applies to the firearms sold by a dealer, or PPT transfers done by a dealer as well.

I'm not arguing that piece. I'm saying the person that wrote the code for the website might have thought all use cases for C&Rs the dealer would click "C&R" instead of the PPT link. That may be why they "hide" Collector as an exemption under PPT.

I was merely providing the OP an alternative to let their FFL Know so it can be released and marked as such in the current DES system until the bug is resolved. There's no disadvantage to this EXCEPT to the seller who won't receive a DES record of the transaction. It would be no different then if the seller shipped. I did this recently for a customer but still only charged them $35 because either way the DOJ only gets the $25 from me. I didn't charge the normal transfer fee ($50) just because I chose the C&R link over the PPT link.

As said it is a bug. PPT for FFLs are also missing the waiting period exemption.

Yes it is not correct but it is not a bug. It is poor coding or even a deliberate hassle from the DOJ. They have so much money from DROS that they are giving it to other departments so they should have fixed the error the first time they were notified.
