Default Consignment Wait Time

I was wondering why you have to wait 30 days before starting DROS on a consignment? Why not start the DROS after 20 days? Is the purpose of the 30 day wait to see if it's stolen and if so can't they just trace ownership from the serial number for handguns? Ten days of waiting is bad enough but 40 days is killing me.

It was my understanding that the weapon has to be at the shop for 30 days. You can start dros anytime during that as far as we are concerned, but you still have your ten day wait and the 30 day hold.

We generally start your DROS around day 18-20 of the hold period and you can pickup after the 30th day.

I have heard the same thing (I don't do consignments, so I don't have to deal with it). You could do the DROS after the 1st day, but then you have only one day to pick it up. The longer you wait, the longer you have to pick it up.

OK, makes sense. I didn't clarify it with them and just assumed that I had to wait for the 30 days before I could start DROS. Thanks for the info.

I went to the store yesterday and they said the CALDOJ told them that they couldn't start the DROS until after the 30 day hold so that it would be a 40 day hold total. Makes no sense.

Yeah, i sold one of my 1911's on consignment. Took the store 30 days before they were allowed to place it on the display. After that I was waiting for 5 months before someone bought it. Remington R1E is not very popular...

That really doesnt make any sense, not starting dros for 30 days. We are required to hold it for 30, but we can display, and sell it anytime we want. Sure, you take the risk that it is blocked, but we start paper within 15 days of the 30.

I couldn't find anything saying that it has to be held for 30 days before the DROS can start. If CALDOJ says they can't then they should get it in writing. I work for the state. Our motto is if it's not in writing it doesn't happen. UGH! Oh well, it's just a two hour round trip for three times.

Business & Professions code 21636 is pretty clear abou the 30 day hold, but would swear I also read somewhere that the item can not be offered for sale during the hold which would preclude doing a DROS.

I'm going to keep looking...

You need to look at the secondhand dealer requirements (FDAS).

OK, I really need a life. I looked at the requirements for the FDAS and the only thing regarding it is this:

Yes. as far as I know, that is the case. Now, the DOJ might make something up and claim you can't start the DROS, but that does not make it real.

Also, realize that something can happen within the 30 days which would prevent the firearm from being transferred, which would make the DROS fee lost (who gets to pay?).

Don't consign. You have to DROS your own gun? they don't tell you that.
