Spy-d, I don't think such a ticket would hold up in court. Perhaps you might get issued one, but I don't see how a judge would find you guilty for doing 70mph when traffic around you was doing 75mph.

Also, if you go to traffic court it doesn't mean you automatically lose the right to traffic school. I have seen judges hand out traffic school in traffic court (not frequently, but it happens).

As for the OP, luck of the draw on whether the citing officer will be there. Most agencies REQUIRE the officer to be there unless there is something much more pressing going on (illness, vacation, held over on a hot call, in a jury trial, etc).
