D.O.J Hold on Gun
Hello everyone! kinda new Here. I was at big5 Sporting last week when I saw a Sig522 rifle that I feel in love with. After doing paperwork and waiting a week so far, I get a call that my gun was being held/delayed. :facepalm: so I call up the D.O.J. and ask about the hold. they say its because It was a felony reduced to a misdemeanor. They are waiting for a response from someone I believe the arresting agency maybe? Anyone have any insight as to when the hold will be released? How long it takes? or what I may do to help speed things along? Any and all advice is welcome.

P.s. I know it was reduced, even says that on my online court search thingy.

Reinstate your right to possess firearms. In some cases, reduction of a non-
violent felony to a misdemeanor may accomplish this.
Was it reduced and dismissed or just reduced?

At Guntech, It was reduced, Its a Long story, Someone Keyed my friends car back in 06 and we followed him and kicked in his door, he fled out the back and called the police "Sigh" Probably should of called first. it was a Heat of the moment incedent.

Did you use forms CR-180 Petition for Dismissal
CR-181 Order for Dismissal

I just went back to the Courts website and It was burglary? we were charged with Even though we didn't steal anything? How is that? I thought it was B&E.
this is what it said.

There is no such crime as "B&E" in California. That's a TV term. Some states may use it, but not CA.

When you kick in a door with the intent to commit an assault likely to produce great bodily injury, you commit the crime of burglary the moment any part of you crosses the threshold of the building. You don't have to steal anything.

So at this point in time I am confused. Was it not reduced? I was under the impression it was. Am I S.O.L? Think they will let me pick up the Sig?

at Gun Tech, I am going to have my wife look into CR-180 & CR-181 Petition for Dismissal
for me when she arrives home from work. I think she can guide me through it and better help me understand what I am reading. All this stress and irritation has left me Flustered & confused. I am hoping all will go well and I will be able to pick up my gun on the 20th as planned. "Fingers Crossed"

According to the court site, it was reduced, but lately DOJ has been requiring more proof of the reduction. You need to contact CGF. They are working on these types of denials.

It looks like you were charged with a felony, pleaded not guilty, then you were sentenced to two counts of Misdemeanor burglary after pleading "no contest." I don't think misdemeanor burglary is on of the misdemeanors that prevents you from buying/possesing firearms. You should be good when this gets cleared up, but I am not a lawyer.

So Im posting a update, after reading through the forum I found this post & had found that I needed to go to the court house for a offical Disposition statement & send it to the DOJ. When I arrived I asked the nice lady there if the DOJ had requested the document after about ten minutes she had come back and told me the court had never sent the document in the first place when i was arrested. ( its a courtesy that they send the document not manditory to DOJ) and thus why im on hold, and that the DOJ had never requested it. So Im confused. Did the DOJ Lie to me about requesting the paperwork? Anywho the lady sent a copy via mail to the DOJ and it will take a few days to send. I also obtained a copy for myself and just faxed it to (916) 227-3744 So finger crossed that when I call them again this evening they relase the hold. even though I doubt a faxed copy will do it for them.

Just got off the Phone with DOJ and it was released:clap: 2-6 weeks can Suck it! They should f just told me to go to the court house rather than telling me nothing could be done. lol But seriously thank you to everyone who Helped in this matter. Will be picking up my Sig 522 tommorow.

you're one of the lucky ones. Just an FYI and not making excuses for anyone but the JD system is so bogged down that unless you actually do the leg work yourself it's not going to happen. This goes to prove that your past can come to haunt you. I hope your an up standing citizen now. Enjoy your new rifle!
