What are the chances a cop showing up to court when he gives out a ticket?

Depends. If there is a heavy workload, He may not show up.

However, When a ticket is issued, the Dept. Will make sure that the officer's shift is covered so He/She can get to court.

Unless he gets stuck in traffic, Then I beleve the court will move the court a few days. On your dime of course.

The basic rule is: Don't get caught. But if you do, Take your punishment.
And be nice about.... They may, Not always, let you go with a warning or traffic court.

CHP Newhall office audits their officers' court appearance. They get in trouble if they don't show up.

The only time I missed court in 30 years was when I was sick.
Why miss it? They pay you to go and if your not on duty, it's overtime.
Besides, the courts rat you off to your department if you don't show up.

hell, i've had one show up for a loud exhaust ticket...first ticket ever, and he wrote it noncorrectible.

Only time I haven't shown up was when I had another case in criminal court. Criminal cases get priority.

Do online traffic school. It is very easy, you can do it at your own pace, and you won't have to leave the house. You can stop in the middle and come back to it another day.

I thought if you tried to fight the ticket in court that you lose the ability to go to traffic school (if you were elegible in the first place).

It's a general rule and there are always exceptions depending on the judge. If you have a court on a busy day then there is no chance. I have however seen people fight the ticket lose and still get traffic school but it's usually on a slower day.

It's been awhile and things may have changed but in Fresno county I was told it was court OR traffic school but not both.

I heard something about that as well.

If you are driving at the POSTED speed limit, And there are other people passing you, You will get a ticket for holding up traffic.

And I am not talking about a 2-lane road. I am talking about a 4-lane Highway Like I-5 or On the 405.

Spy-d, I don't think such a ticket would hold up in court. Perhaps you might get issued one, but I don't see how a judge would find you guilty for doing 70mph when traffic around you was doing 75mph.

Also, if you go to traffic court it doesn't mean you automatically lose the right to traffic school. I have seen judges hand out traffic school in traffic court (not frequently, but it happens).

As for the OP, luck of the draw on whether the citing officer will be there. Most agencies REQUIRE the officer to be there unless there is something much more pressing going on (illness, vacation, held over on a hot call, in a jury trial, etc).

I know. Up where I live, The posted speed limit is 30 MPH. We have 4 lanes through town. IF you are doing 30 and everyone else is at 45, Then you are creating a traffic problem and you can get a ticket.

Failing to keep up with traffic is a citeable offence.

Really? Please quote the vehicle code section that states that you must exceed the posted speed limit if everyone else is speeding.:facepalm:

I believe you are thinking of minimum speed law / impeding the flow of traffic 22400a CVC. I'm not sure given your example that would hold up in court. Since everyone else is in violation the posted speed limit. You would need to be causing a significant delay to traffic by driving well below the posted speed.

I can't recall a citable section that requires slower drivers to keep up with traffic flow. 21654 a CVC requires slow moving vehicles to drive as far to the right as possible, not keep up with the flow of traffic.

And if you are hauling something on a 2-lane road and you have more than 5 cars behind you, you are required to pull over and allow them to pass, IF you are driving UNDER the speed limit.

I think you missed the point neither of those sections require someone to speed up to keep up with or move over for traffic traveling at greater than the posted speed limit. It's polite to move over out of the #1 lane if traffic is traveling much faster than you, but since most drivers in Ca. seem to have no idea what polite means it is a rather moot point.

Am I the only one here who freakin hates traffic court with a passion? Unless you were a huge a-hole, you won't see me there. Maybe has something to do with working mids and traffic court being at 1330...I'm not waking up in the middle of my night to hear you whine about a ticket for a seatbelt! Diiiiiiiismiiiiiiiiiiissssed.

When cops don't show up, it isn't because it was a "bad ticket," like some posters think. Its because either they are sleeping, or got it dismissed prior, or have real court, or just don't give a F. My dept had such a problem with people not showing up that they started doing IA investigations. 5 FTA's meant one day off. Its just a quick memo to dismiss and now people don't forget to write it.

Lets see.... Califorina Drivers Handbook 2012, Page 29.

Reduced speeds.

You must drive slower when there is heavy traffic or bad weather.
However, If you block the normat and reasonable movement of traffic by driving too slowly, You may be given a TICKET.

I haul arcade machines, Up to 8 of them in my F250. When there is a line of traffic behind me, I ALWAYS pull over and let them pass. Otherwise, If some one thinks that they can pass on a curve, They will try.

California has a Basic Speed Law. This law means that you may never drive faster than it is safe for current conditions.

If I am hauling a heavy load, and I drive too fast, I could cause a pileup. But if I drive too slowly, Then I am creating a traffic hazzard. So, If I am hauling a load (3000+) and I drive 55 in a 65 mile zone, Am I required to pull over to let others to pass?

As for the rock, I live under one. I am a Rancher/Farmer. I also repair full size arcade games.

Seriosusly, If I get a ticket for driving too slow, With 2 tons of walnut shells in the back of my F250, Can I call you as an expert wittness?

And this is not cop bashing in any way or form. I put many miles driving to and from work. I have hauled almost every kind of arcade machine you can think of. In Sac, 1994, I was so overloaded with a pool table, Pinball and a kiddy ride in my 87 Ford Ranger, I had to be very carefull that the front end wouldn't come off the ground. And there was a CHP following me from the mini-storage to our shop.:eek:

And this, Is a M151A2 1/4 ton Military Jeep I stuffed in my 87 Ford Ranger.:D

I'm not sure about the roads you regularly drive, but all the ones around me that are 65-70mph are at least two lane. If you are in the right lane doing 55mph and you get a ticket for impeding traffic, I'm willing to bet you some 5.56 ammo that it will get dismissed in traffic court!

As for ilduche, why do you even write tickets if you are unwilling to go to traffic court? Seems like there is a very easy way to prevent such a thing from occurring in the first place...

one of my speeding tickets was in a 70 mph zone...left and middle lanes (of 3) stacked up, big rigs in the middle, cars in the left lane with some idiot at the front of the line in the left lane going 60mph.

i went blazing by on the right, to find a chp sitting in front of the line of rigs in the middle lane. :facepalm:

I used to get a lot of tickets as a younger and dumber man. I always fight a ticket. I've got about a 50% success rate for officers not showing up. I drive for a living now so I will still go to court, gotta protect that driving record......

I can vouche for spy-d, I'm a commercial driver and HAVE been pulled over for 'stacking up a line of cars and not pulling over to let them pass' granted there was NOWHERE to pull over on a 2 lane road in the mountains.

IDK spy-d maybe its just a NOR CAL thing. As a commercial driver up here we all have to deal with it regularly. Having to pull over up a tough climb and come to a stop then try and start up the hill again. BS Law if you ask me.

Not cop bashing, just trying to help.

No person shall bring a vehicle to a complete stop upon a highway so as to impede or block the normal and reasonable movement of traffic unless the stop is necessary for safe operation or in compliance with law.
