2014 session CALIFORNIA BILLS INDEX Thread
 
Here we are in December 2013, and the second half of the CA Legislature's 2013-2014 session is nearly upon us.

Feel free to add a post announcing a new bill, as you encounter one.

Links to the actual bills are very helpful. Please do not title threads 'Oh, they're being stupid again' or other expression of outrage - title it more like 'AB 12345 El Diablo Ammunition (2014)' -- the bill number, the author, the subject and the year all help us keep track. Honest, folks, one thread per bill is plenty.

And, it's my personal opinion that all the anguish that get posted is rewarding to the people who write and submit the bills.

Remember -
  • passing out of a committee does not mean 'the law passed';
  • passing from one house to another does not mean 'the law passed';
  • passing through both houses and going to the Governor DOES mean the bill passed;
  • ONLY WHEN the Governor vetoes a bill do we know a bill that gets to him is maybe dead, because a veto may be over-ridden -- the Big Date is September 30.

Here are the significant dates, from the Legislative Calendar:

January Deadlines
• Jan. 1 Statutes take effect (Art. IV, Sec. 8(c)).
• Jan. 6 Legislature reconvenes (J.R. 51(a)(4)).
• Jan. 10 Budget Bill must be submitted by Governor (Art. IV, Sec. 12(a)).
• Jan. 17 Last day for policy committees to meet and report bills introduced in their house in 2013 for referral to fiscal committees (J.R. 61(b)(1)).
• Jan. 24 Last day to submit bill requests to the Office of Legislative Counsel. Last day for any committee to meet and report to the Floor bills introduced in their house in 2013 (J.R. 61(b)(2)).
• Jan. 31 Last day for each house to pass bills introduced in their house in 2013 (Art. IV. Sec. 10(c)) (J.R. 61(b)(3)).

That is, some bills introduced in 2013 are still alive, and may be considered in January.


February Deadlines
• Feb. 21 Last day for bills to be introduced (J.R. 61(b)(4), J.R. 54(a)).

All the 'bad things' in original bills must be introduced by Feb 21 - but "gut and amend" may still bring us some pain.

April Deadlines
• Apr. 10 Spring Recess begins upon adjournment (J.R. 51(b)(1)).
• Apr. 21 Legislature reconvenes from Spring Recess (J.R. 51(b)(1)).

For about 11 days, we are free from the baleful influences.

May Deadlines
• May 2 Last day for policy committees to meet and report to Fiscal Committees fiscal bills introduced in their house (J.R. 61(b)(5)).
• May 9 Last day for policy committees to meet and report to the floor nonfiscal bills introduced in their house (J.R. 61(b)(6)).
• May 16 Last day for policy committees to meet prior to June 2 (J.R. 61(b)(7)).
• May 23 Last day for fiscal committees to meet and report to the floor bills introduced in their house (J.R. 61(b)(8)). Last day for fiscal committees to meet prior to June 2 (J.R. 61(b)(9)).
• May 26 Memorial Day observed.
• May 27 - 30 Floor session only. No committee may meet for any purpose (J.R. 61(b)(10)).
• May 30 Last day to pass bills out of house of origin (J.R. 61(b)(11)).

June Deadlines
• June 2 Committee meetings may resume (J.R. 61(b)(12)).
• June 15 Budget bill must be passed by midnight(Art. IV, Sec. 12(c)(3)).
• June 27 Last day for policy committees to meet and report bills (J.R. 61(b)(13)).

July Deadlines
• July 3 Summer Recess begins upon adjournment, provided Budget Bill has been passed (J.R. 51(b)(2)).

August Deadlines
• Aug. 4 Legislature reconvenes from Summer Recess (J.R. 51(b)(2)).
• Aug. 15 Last day for fiscal committees to meet and report bills to the floor (J.R. 61(b)(14)).
• Aug. 18 - 31 Floor Session Only. No committee may meet for any purpose (J.R. 61(b)(15)).
• Aug. 22 Last day to amend bills on the Floor (J.R. 61(b)(16)).
• Aug. 31 Last day for each house to pass bills (Art. IV. Sec. 10(c), J.R. 61(b)(17)). Final Recess begins upon adjournment (J.R. 51(b)(3)).

IMPORTANT DATES OCCURRING DURING FINAL RECESS
2014
• Sep. 30 Last day for Governor to sign or veto bills passed by the Legislature before Sept. 1 and in the Governor’s possession on or after Sept. 1 (Art. IV, Sec. 10(b)(2)).
• Nov. 30 Adjournment sine die at midnight (Art. IV, Sec. 3(a)).
• Dec. 1 2015-16 Regular Session convenes for Organizational Session at 12 noon. (Art. IV, Sec.3(a)).

Just a reminder - in the bill text

RED STRIKEOUT is deleted from current law,

BLUE ITALIC is added to current law,

and black normal text already exists - that IS current law -- but in subsequent versions of the bill, the red/blue will indicate changes relative to the prior version of the bill.

That's easy to see here, since this is a big change from the prior version - lots of red strikeout where the old text has been discarded.

They go on to say

Is this really it for the year? Question for Librarian or others who know, if a bill was placed in suspense or otherwise abandoned but not voted down last year, would it have to be re-submitted to be considered this year, or is it still a "live" bill for the next session?

Anything suspended or left open from last year is still active this year. Bills are open for an entire legislative session unless killed or passed.

is scheduled to be heard in the Assembly Public Safety Committee.

AB2305 would significantly expand California law by imposing criminal
liability if an individual unknowingly carries a firearm on_or about_his
or her person.

AB 2305 improperly seeks to bypass a recent decision
by the California Court of Appeals. Also, it fails to advance any
legitimate public safety interests and will result in inadvertent
criminal liability for law-abiding citizens.

AB 2305 directly conflicts with constitutional protections for carrying a
firearm for self-defense as recently confirmed by the Ninth Circuit
Court of Appeals.

AB 2305 is being pushed by Los Angeles prosecutors in an effort to
circumvent the recent California Court of Appeals decision in_People
v. Pellecer_, 215 Cal.App.4th 508 (2013). That case specifically held
that individuals should not -- and cannot -- be held liable for
unlawfully carrying items properly stored in a backpack or purse,
instead of carried directly on their person. In the_Pellecer_case, an
individual was wrongly charged with carrying a knife in his backpack.
AB 2305 would end-around that decision, and go so far as to apply the
expanded carry prohibitions to firearms.

Thread needs an update. 2013-2014 session is at an end.

Status of the 2014 bills as of 09-02. Seven bills awaiting Governor action, two chaptered (signed into law) and nine bills with a fork in 'em.
