CALGUNLAWS.COM POSTS MEMO ON SIGNIFICANCE OF PROP H VICTORY

On behalf of the legal team that was privileged to represent the National Rifle Association and the other petitioners in the lawsuit successfully challenging Proposition H, the San Francisco Gun Ban initiative, I wanted to get some information out so that folks can understand what went into obtaining this fantastic decision and can fully appreciate the significance and value of the results. A memorandum discussing the ramifications of the decision, along with all the briefs filed in the case, can be reviewed at www.calgunlaws.com. The pinpoint address is: http://www.calgunlaws.com/article-454.html

The central issue in these lawsuits was the extent to which California state law preempts local gun control efforts. The decision underscores the importance of strong state preemption laws. Forty-three states have preemption statutes. California’s statutory scheme is not as clear as some in other states. California’s preemption law prohibits local governments from banning handgun possession and from establishing their own “licensing” and “registration” systems. The extent to which these preemption statutes prohibited local gun ban efforts was hotly contested in the case. The successful result should go a long way toward stopping many of the ill-conceived gun control ordinances that have been proposed at the local level in recent years.

Please take a minute and review the materials posted at www.calgunlaws.com about the litigation. The City’s position on why the California Supreme Court should review the case is particularly interesting.

A list of all the associations and individuals who participated in the lawsuits challenging Prop H is available there, as well as some thoughts about the significance of this case with respect to future local gun control efforts in California.

It's too bad that the "Talk to Chuck" slogan is used by Charles Schwab stockbrokers.

But we can always refer to TMLLP as The Right People :)

Thanks, Chuck!

Heh. Ask Chuck whether "specific performance" is really prohibited by the 13th Amendment. :reddevil:

And Congrats again to Chuck and team on a big win!
