View Full Version : Intra-familial handgun transfer CADOJ question
I'm a 20year old Criminal Justice Major and will be testing at my local S.O. in the furture so I have wanted to get used to the their standard duty weapon which is a Glock 22 not saying I don't have experience w/ it but I wanted to take it out of state to front site and Tactical response and last month my father did a Intra-familial handgun transfer w/ me on both of his G22 & a 1911. I have purchased firearms before and have my HSC, I filled out the form and sent it w/ the $19 USPS M.O. on February 7th, I was wondering How long is the wait till they send their letter confirming it ? Should I give them a buzz or just wait ?

Give them a call.. I did one and it only took maybe about 2 weeks..

I have yet to get a letter when i did mine. But they cashed my check quick.
Ok the DOJ said it takes between 1-2months for them to switch the handguns to your name and then thats when you get the confirmation list... well I got a month done lol

Since you paid the money and did the paperwork what would stop you from using it at Front Sight anyways without receiving word back? Does Front Sight require something to prove you are the registered owner? If not, and you know you are not in a prohibited class, then you should be good to go.

There's no law saying you need papers back from DOJ for intrafamilal transfers. There is no 'waiting period' for this process - dad hands you the gun and you filed the paperwork.
YOU DID YOUR PART - YOU FILED.
As long as you hold a valid HSC card, and your transfer form is true, correct and complete to the best of your knowledge, and your $19 check (or whatever the fee these days is) doesn't bounce, you're fine.
If it's more comforting, keep a copy of the paperwork with you. Front Sight's in NV anyway, and it's a free state.
[Aside from this, you also have coverage for 30 days from the 'infreqent loan' provisions in 12078(d)(2) PC.]
Bottom line: you own a firearm that you can legally own & use; Pops doesn't have to keep holding onto it for release of DOJ papers.
A friend of mine who owns a gun shop just said to be careful when traveling and to try to get the paperwork because a Peace officer could pull you over and might not know the laws about the intra-familial transfer where you can have a handgun under the age of 21 and then they could confiscate it and you would have to go to their station and bring the paperwork showing you do own that weapon. Its the same thing when you have your CA legal AR or AK, you have the all the necessary paperwork w/ you (hopefully you do) just to be on the safe side. I asked my Uncle and Cousin who are both Peace officers and they said to have a copy in w/ the handgun and in you glove box just to be safe

I put one in last July and got the acknowlegement in about 70 days.

I did one a couple years back and it took about three weeks for them to main back a confirmation.
I've heard that more recently it takes a lot longer.

honestly, what cop will run the serial number on your gun if you have it in a car? why even bother admitting you have it? without a search warrant, no cop is searching my car.

Well I wouldn't care if they did run the serial, I don't have anything to hide
(I'm 100% legal) but if you are stopped for some reason and they ask if you have any firearms in the vehicle, you do have to let them know you have a firearm in the car and I believe they can legally perform a safety inspection of the weapon w/o a search warrant. Since I'm not 21 I didn't want there to be any confusion when I'm traveling throughout the state to various ranges even if I am the legal owner, Thats why I was just wondering how long it would take for them to send a confirmation letter back...
Now that I know it takes awhile, I'm not going to worry about, just be careful as usual and when I get it I'll through a copy in the gun cases and one in my glove box.

I'm sorry that you havent' been told, but the constitution has kind of gotten crapped on for the last 50 years. Cops can search you (via a patdown) and your car without a warrant if they have reasonable suspicion that you are "dangerous." The only exception is for locked boxes and trunks. Also, although objecting to an illegal search is a good idea, trying to actually physically stop it is not.

Physically resisting is not good, that is true. I can't seem to find where a citizen is required to admit to possessing any gun in their vehicle. Could someone please tell me where in the legal code I am required to do so?

You are not, you still have a 5th amendment right (although that is being whittled away with stop and identify laws). I'm just saying they could search your car if they felt like it essentially.
