So the deal is that I work about 6 months or so a year for the studios in CA (which also means i need to keep my ca cdl), when I am not employed I stay in st. george utah helping out my grandparents doing what I can for them. The main question I have is since I legitimately live in utah half the year do you think I could legally possess a utah state id to purchase firearms at the local dealer there? I have called the dmv numerous times and cant get a straight answer on wether it would be legal or not....

According to the ATF you can. As long as they're no state restrictions.

(B12) May a person (who is not an alien) who resides in one State and owns property in another State purchase a handgun in either State?

If a person maintains a home in 2 States and resides in both States for certain periods of the year, he or she may, during the period of time the person actually resides in a particular State, purchase a handgun in that State. However, simply owning property in another State does not qualify the person to purchase a handgun in that State.

I read about a family from Florida who lived half the year in MN and half the year in Florida. Well, the FL Supreme Court ruled they were legitimate Florida residents. So if it's more than 30 or 90 days, your situation sounds comparable. Do you vote and pay taxes in Utah? Ultimately, you'll have to check with an attorney rather than rely on what someone told you on the internet.

Welcome to the forum!

You will need to provide established residency in the state you wish to purchase a firearm, a DL or utility bill in your name will work.

I think I just need to become a illegal alien so none of the laws apply to me

Since you're technically required to get a CA DL after being here 30 days, do what the Actors do- leave the state for a few days every 29 days or so- take a weekend in Vegas or something.

Depends on the State of Utah's regs. If they will allow you to get a Utash ID card while retaining your Cali CDL, do it.

Unfortunately none of the states i have vacation homes in will allow it. But Utah isnt one of them. Its worth a shot.

Does getting a resident Utah CCW help with the firearm purchasing process? I know in TX, your CCW is just as good as a DL.

if you live 1/2 year here and 1/2 year there, how do you get a DL in both states... do you need to surrender your DL in one?

its illegal to have more than 1 state dl. you can thank the old truckers for that.

You maintain your DL in your other state. You never 'officially' become a resident of CA.

Uh. . .wrong.

I maintain houses/property in Ohio, Florida and California. I have legal I.D.'s for all three states.

Does that mean you can buy a firearm in Ohio and bring it into California as long as it doesn't violate 10-round, AW or other California laws?

I livei n CA, but go to school in Missouri 8 months out of the year. I maintain a CA Drivers License AND a MO Non-Driver Lisence. This gives me the option to purchase firearms in the state I am living in at the time. Just make sure that you truly consider yourself an actual resident in whatever state you are buying the firearm in. If you are just "visiting" utah for a weekend I wouldn't recommend buying a firearm and bring it back to CA--thats not kosher. But if you are legitimately moving from one state to another, there is nothing to stop you from bringing your firearms with you(unless its an AW and you are moving to CA).

I think I read that if you're moving to CA and own a non list handgun, you may import it into California as long as it doesn't have illegal features. I think you need to fill out a CA DoJ form for this. I could be totally wrong about this of course so YOU should read up on it.

This is an interesting thread as I have a residence in Las Vegas as well and I'm there at least once a month although I do have a CA DL.

If I switch to a NV DL I wonder if that means I can store my NV purchased non CA handgun list guns in my CA residence legally as long as they do not contain illegal features if I decide to keep my NV license.

My guess would be probably not since I bet it falls under a code where an out of state resident drives through the state.

If one brings a handgun into CA (subject to certain limited exceptions), one needs to declare them as a personal handgun importer using the DOJ form and pay the $19 each within 60 days of any of the handguns entering California.

One can't just "decide to keep your NV license" and purchase handguns in NV as much as you'd like. One needs to truly intend to make both states your permanent residence. One can't purchase a handgun in a state that is not where one does not have a permanent residence.

This is the form. (http://ag.ca.gov/firearms/forms/pdf/ab991frm.pdf) It does have a section for CA DL # or ID # or a Military ID #. Now, I don't know if they won't process the form if you don't give them that. The statute doesn't require it, but it's not like the DOJ follows the statutes.

One probably could get an NV ID and a CA DL and be fine. I know that the CA DMV likes making you surrender out of state DL's and so they can punch holes in them.

Ok it seems it may be kind of shady so I'm just going to drop the idea. I do want a P229 Elite bad but not that bad.
