As I understand it, the markings must be a minimum of 1/16" tall font & .003" deep.

Beyond that, is there specifications on location? Left or right side? Inside the fire control well? On a Quentin Defense lower (http://quentin-laser.com/store/product_info.php?cPath=27&products_id=159), the magwell is beveled, so I was thinking of marking it on the bevel.

Links to ATF or CA DOJ letters with specifications would be most helpful. Opinions and conjecture, not so much.

K, your picture didn't post (not for me anyway) only the boxed red 'X'.

Alpha-numeric, no symbols, in a visible location without disassembly required if I remember correctly.
There was a thread about this 2-3 months ago, I'll let you go through the frustration of searching for it :p

As I understand it, you don't have to mark it unless you're going to sell it or register it. (Someone correct me if I'm wrong.)

This is true.

However, I have been witness to ignorant law enforcement actions and how they effect law abiding citizens.

Less Drama leaves more time for fun.

There are no requirements on size, depth, or what needs to be marked on a homemade firearm unless it is being transferred. So, use a sharpie if you want and write whatever you want on your homemade gun unless, you are about to transfer it.

You don't have to mark it in any way under California law. But, your in for a real problem if LEO finds you with it and asks where it came from.

For this reason I always mark my builds with :

1) initials
2) place of manufacture (city, etc)
3) a made up serial number (mine only have 3 digits)

This is all a courtesy to law enforcement. When you go to sell your gun (which is totally legal) after waiting a good long time (don't get accused to making and then selling within a short period of time) then you need to mark it before sale.

There is no spec for depth or size.

Hoffmang's letter (http://www.hoffmang.com/firearms/BATFE-AMD-65-Manufacture-Marking-2004-11-09.pdf) led me to 27 CFR 478.92 (http://www.law.cornell.edu/cfr/text/27/478.92), but that addresses requirements of LICENSED manufacturers.

I think that the cannon man is correct, I can mark away as desired.

There is no spec for depth or size for homebuilds because S/N's aren't required for them. It would be wise to follow the specs that manufacturers must use if you decide to engrave your homebuilds. For that, there most certainly is a spec for depth, size and to some extent, location.

See..... You and I are at opposite ends of the spectrum....

*IF* I put a serial number on one.... I would make it AS LONG AS POSSIBLE just to screw with them.... probably do it all binary 1's0's..... It would go across the entire magwell, into line 2, line 3 line 4......

I have a hard time believing there is a "LEGAL" length limit to a serial.... I'd cover the whole mag well with 1's and 0's, and call it "texturing" for high speed low drag operators.....

If LE wants to confiscate... "I'll need a reciept including serial....."

Heck yeah... screw with them and make it as long and complicated as possible... just cuz you can!!!!!!!!!

Yes that is correct there is no requirement because I already have gotten clarification from the BATF&E. I can do gunsmithing and coatings on completed personally manufactured receivers/frames with no markings needed on them beyond a manufacturing stamp of who made the paper weight.

So that should mean the same for everyone else as well.

There is a fad that seems to have started on AR15.com several years ago of duplicating the engravings of a M-16 including the government property mark and the Colt rampant stallion logo. On many levels this is not a smart idea in California. A couple of weeks ago I watched as a guy who had paid $100 to have this done buff it out. No anodizer would touch it and a LEO friend explained that the property marking were probable cause to take the gun to investigate. Finally someone was kind enough to explain trademark law to him.
