View Full Version : Can someone explain to me why this person wasn't charged for shooting in public?

So this happened in Oakland a few months ago and the video in a whole is a damn shame but my question is why the person starting at the 1:27 in the video wasn't charged with any crimes. The chances of that guy having a ccw permit is what .001%? I've read about people being arrested for way less but this guy gets away because he was being shot at supposedly first?

So, Oakland's councilman is invoking stop and frisk?
Because the OPD does not have the resources available to go investigate this kind of stuff and or not in the interest of officer safety, maybe :confused:

No jury appeal. Sounds like OPD sent the case to the DA and the DA declined to prosecute. They probably figured that a jury would look at it like it was a self defense case, on the felony negligent discharge of a firearm. DA's want to try cases that they can win, if there is any doubt in their mind as to being able to win a case it will rarely see a court room. I'd be willing to bet that is what happened here.
