View Full Version : Shooting on private property in rural Yuba County...

Anyone know where I can read what the law actually says? I have an over-zealous neighbor that claims we can not legally shoot up there, however everytime the Sheriff's Deputy shows up he basically tells us to carry on because we are not doing anything illegal.

What does the law say?

If the Sheriff has told you time over that you are ok, tell your neighbor to kick rocks.

Edit: Tell your neighbor to head on down to the Sheriff station if he/she thinks what your doing is so illegal.

Precisely what I said... I told him that we will continue shooting, and he should go back and call the cops again. We do not want to do anything illegal, so if the Sheriff comes here and tells us we are violating some county ordinance we will stop! Oddly enough, the Sheriff did not come back out just as he said he wouldn't:)

I would still like to see it in writing though...

You are asking for documentation of a negative. Nowhere will you find written down what is legal ;)

Tell your neighbor that you're inviting the deputies back after their shift for a little shooting competition.

The list is only a few areas and highways. You can shoot safely pretty much everywhere else from what I read there.

Well, since it looks like it is legal and the SO said that it was legal, how about inviting your fello Cal Gunners to shoot in your property:43:

8.20.610 General Provisions. Notwithstanding any other provision of this chapter, and in addition
thereto, it shall be unlawful for any person to willfully make or continue, or cause to be made or
continued, any loud, unnecessary, or unusual noise which disturbs the peace or quiet of any neighborhood
or which causes discomfort or annoyance to any reasonable person of normal sensitiveness residing in the
area.

I believe this would apply to you.

First of all, I believe it would be difficult to prove I was being "malicous". Second of all, I don't know that the term "neighborhood" applies in this context...we are talking about a 40 acre piece of property out in the sticks!

Thanks Gene, I'm glad I re-read that. At first glance I thought it was saying it was unlawful to shoot anywhere other than those areas described but the opposite is the case. Shooting is prohibited in those specific areas described...guess I'm in the clear as far as that goes!

Being a good neighbor may be a whole different story, but we have been shooting up there since 1989 and we're only talking one Saturday every two or three months!

The other funny part of the story is that one of these neighbors is the former Sheriff of Yuba County! She claimed to have heard machine gun fire! I have never seen a "machine gun" in person, let alone have I shot one on my property!

Anybody know if Yuba has any specific ordinances on open carry in the unincorporated parts?

You aren't thinking this through. You should go into the Sheriff's office and file for a permit to acquire a few sound suppressors citing the reason being you don't want to distrub the neighbors.:jump:

From what I have been told Virginia was not a very good shot either... :rolleyes:
