19-DECEMBER, 2007. MILPITIAS, CA.
FOR IMMEDIATE RELEASE.

Nearly 2 years after they were siezed, amidst much controversy, 219 hotly contested firearm components have been returned to their rightful owners.

Thanks to the combined efforts of members of calguns.net, a web forum promoting individual rights, unlawfully taken personal property has been returned to it's rightful and legal owners.

Participants must undergo yet another 10-day waiting period, as these harmless looking chunks of aluminum are still technically 'firearms'.

This is yet another example of what good people can do when we come together openly and honestly. I thank you all for your continued support, and look forward to what 2008 will bring.

All Milpitas Group Buyers are cordially invited to a release party early Jan 2008, date and venue info will be distributed.

I'll post the docs later, but here is a basic background from my point of view allowing Ben to comment on some of his details separately.

I acquired the interest in 2 Lauers from other CGN members. I filed for a LEGR on my two lowers that I got back in mid July of this year. I engaged Don Kilmer to and filed the LEGR and a pleasant request for release of those lowers directly to me pursuant to the law in late July.

We hadn't heard back from BoF so we sent a less pleasant demand (including a threat of legal action) but it turns out that our demand and Alison Merrilees' response crossed in the mail. She claimed that because I didn't own the lowers when seized I couldn't claim my own property. She also tried to claim that I couldn't get them back because they weren't registered in AFS (read a handgun or an AW) which is just laughable.

We responded asking telling her she was wrong on the law and demanding to know why she was claiming that long guns were registered in California. We then told her that we would accept her transferring the lowers to an FFL of mutual convenience for final transfer to me and gave her seven days which was the end of August.

We didn't hear anything back and began drafting a lawsuit for violation of my due process rights under the 14th and 5th.

Alison, under pressure from us and from TMLLP on Ben's behalf, finally sent a letter in mid September stating that she was closing her supposed investigation and instructing Ben to tell BoF where to send the lowers.

Due to some crazy schedules (try co-ordinating two law firms and two busy entrepreneurs plus an FFL :D) it took us some time to get the pickup arranged.

Yesterday (Wed Dec 19) Don Kilmer and the Milpitas FFL drove to the BoF training center in Rancho Cordova and picked up 219 off list lower receivers. A small group of us got together for a celebratory steak and to plan some more new trouble that we'll be talking about in the new year.

Frankly I barely care. I still have not discounted the possibility and would not do this sort of thing again if I were DOJ, however our time is likely going to spent elsewhere. I will add; DOJ dodged a 1983 and other legal 'bullets' if you will pardon the pun, which were not bluffs.

I'm preparing a full story on the whole saga, there's some good stuff to this tale!

I am glad you guys got them back. They were takenn a few months before I moved out of state.

If any of you want to sell one let me know, I believe atleast one NEEDS to be made into a real AR. I could always take pic's after its done and mail them to Allison.

Nice work, Gene. Nothing makes me happier than to see these BOF folks out-worked on their home turf by much more meticulous (pro-gun) minds. As you say, freedom is "free as in free speech" not "free as in free beer". It takes work, money, and persistence.

That cave in letter from Alison reads just like my letter. Lots of what could happen and nothing solid. These guys live off of fear. How sad.

I would respect the BoF so much more if they would just relax and treat people with respect. You don't have to screw with people, just say what you are going to do and do it. If you are not going to do anything, don't say anything.

These letters make me angry. Those four receivers are my property, they were seized from my FFL while I was in the 10 day waiting period, and I wrote letters to the DOJ demanding my property back. Then she offers Ben the opportunity to destroy my property. I'm glad he didn't take the chance.

What a crock. There is a certain DDA that doesn't understand federal and state firearms laws and should be fired. The whole claim is ridiculous on the face of it, if you just read the law excerpts she puts on the first page of the letter. They clearly do not apply to the facts of this case. DUH.

Sorry, I haven't had a chance to read your documents yet; I just read the ones that Ben posted.

Yes that is an interesting "loophole" (or I would call it, a "legislative deficiency". Our firearms laws are so complex and poorly architected that there are numerous deficiencies that show up all the time. The whole "DROS" system really runs counter to common law and property rights, so when you have a corner case such as this, it stresses the written conditions a bit, and we rely on common sense to get us through.

The trust that we put in our government, and specifically the executive branch is that they will fairly enforce laws and give citizens the benefit of the doubt and treat us fairly. Clearly there is something wrong here.

I'm going to read your documents next.. I'm sure it will be good entertainment.

That was the crux of my response, I cannot speak for 217 of the guns, as they are not my property. 2 of them are, and THOSE two, YOU MAY NOT HAVE!

From your letter to Allison it sounds like she was abusing her authority and knew it. I think that is grounds for being fired and disbarred. Then again, I think this is just one of many actions she took that deserves the same punishment. Shouldn’t we ask the federal government investigate this?

It gives new hope that someday we will no longer be harassed by the people that are supposed to be here to protect the law. When will they learn that good people will fight for their rights and not allow them to make up Law and try to enforce it.

They just wanted to throw the 220+ receivers at 'em and have 'em leave.

I'm surprised Iggy just didn't put 'em in a brown paper bag and meet them in an Albertson's parking lot, like he did with mistakenly-seized C&R gun.

Son bought his lower from this Milpitas shop - he was one of the lucky ones whos Lower was taken/held/stolen (however you want to say it, lol) Any, just called him to ask if he has heard anything?? He said he wrote this off long ago - I told him about this post... ask him what if any paperwork he had... he said all he got way back when was an email stating that his elect payment was received.. then all the crap happened... No more contact - this was so long ago that he does not have that email any longer

back in the very begining I bought a lower, waited my 10 days and picked it up, no problem.... then ALL the yes we can build, no we can't build then well, maybe we can build but have to have a Mag lock installed , then maybe not... I got so tired of trying to figure it all out - a friend WANTED my lower, so, I sold it... Now my stepson is suppose to get his from the group that was seized......

So, here is 'my' question... Since I have been out of touch on these - can lowers here in CA be built into a weapon - detachable mag and all???

C'mon... stuff has changed in two years. Our execution has gotten a lot better.

Bullet button (vs other mag locks).

U-15 and Monsterman Grip (vs having.. err... nothing).

Admittedly, not a LOT has changed, but it's gotten a lot more comfy using your off-list rifles.

YES, But no pistol grip.

You can build either a "featureless" build (no pistol grip, flash hider, etc.) that can have a detachable magazine, or a "fixed magazine" build which needs a pinned 10 (or less) round magazine, but can have a pistol grip and any other "evil" features.

The Bullet Button style magazine latch is a nice way to build a fixed magazine gun, but still be able to remove the magazine when necessary for maintenance, loading, clearing a jam, etc. Just make sure you never put in a magazine which holds more than 10 rounds.

If you want to be able to use larger magazines and/or drop magazines without using a tool, then you will need to use something like a MonsterMan grip in place of a pistol grip, and make sure that the build doesn't have any of the other banned "evil" features.

Nearly 2 years after they were siezed, amidst much controversy, 219 hotly contested firearm components have been returned to their rightful owners.

Thanks to the combined efforts of members of calguns.net, a web forum promoting individual rights, unlawfully taken personal property has been returned to it's rightful and legal owners.

Participants must undergo yet another 10-day waiting period, as these harmless looking chunks of aluminum are still technically 'firearms'.

This is yet another example of what good people can do when we come together openly and honestly. I thank you all for your continued support, and look forward to what 2008 will bring.

I bought a lower "SPECIFICALLY" for my first AR "style" build... It was one of the seized lowers I believe from this deal.

...My buddy had two in there 10 day jail period and then they got taken. So he bought 2 more and when they were finally released I had to have one of the seized ones.

These lowers changed they way we do stuff in California.
