Can you use the .40 cal mags in the 9mm (essentially making it a high cap mag)? I know it is illegal, but just wondering.

it is not illegal. if it is designed and manufactured as a 10-round mag, that's what is it. if you can stuff a few more 9mm rounds in a .40 mag, that's fine.

But wouldnt it look bad to LEO if you were involved in a situation where you drew your weapon and you have a 9mm XD but a bunch of .40 cal mags?

On the 40 cal mags you might have to pinch the feedlips slightly. If you don't the slide will lock back with one round still in the mag. This is because the smaller 9mm round will allow the follower to ride up higher on the last round. If you don't pinch the feedlips too much the mags will work in both xd40's and xd9's. I used the xd40 mags for pistol matches. I would personally stick with the 10 round xd9 mags for home defense then there is no questions asked.. Mark

If modifying the feed lips makes the mag non-functional in the .40 gun, you've just created an illegal magazine. Law allows changeability from one gun to another, as long as the magazine remains functional in the original gun.

but as long as they don't stop you with more than 10 round in the mag they would never know. Hell a lot of mags aren't even marker for caliber anyways.

I just shoot my XD 9 wih my buddys XD-40 mag and it worked just fine with no mods to the mag or gun.

My $.02 ....
I use my xd-40 mags in the xd-9 with no alterations. they run 100% and always lock open after the last round is shot. Other than being able to stuff 3 more 9's in the tube, there is no difference. Also there is no marking on the tube or base pad.

In my mags, yes, if you accidentally used a 40 mag in the 9, it holds 3 more.

The base of the magazines is indeed marked, I assure you. If yours are not, you have one of the first production mags. The current production mags are all marked.

I'm no lawyer, and I have no comment on whether or not this is legal. I do think it's stupid though. :p

I`ve also heard the 9rd 45GAP mags will hold 12rds of 40S&W.
But I doubt it would be legal here in Cali. Prior to the ban sun
Setting alot of folks in free states where using 40S&W mags
To get 15rds in their 9mm XD`s. There where several threads on
xdtalk about doing this. There was even a post with a letter
From BATF stating that it was legal. Beretta,sig,and some hi-power
Mags can be made to fit by Cutting a mag catch notch in the
Front of the mag. These will not hold the slide open after last
Rd has been fired. During the ban Springfield used to include a
Flyer with an offer for 2 modified standard beretta mags.

Then posting it in the legal forum is the really questionable part. ;)

Manufacturing means making something. It's ridiculous that they consider use manufacturing. I'm quite certain, if someone challenged this idea of "manufacturing" by putting 12rds in a 10rd mag it would fall to shreds. It makes zero sense. Am I manufacturing a car when I put gas in it?

And my guess illegal as hell if you had in anyway more then 10rds in the handgun. just like some of the ar 10round mags might hold more then 10rnds bad bad
