Hello,

I recently tried to purchase a hand gun and was placed on a purchase hold until I could veifry that I was not convicted of a charge back in 1989 (Charge was dismissed). I was told by the DOJ if they could not verify that no charges where brought against me, I would have to clear it up myself. I went a head and called on the court clerk who was very helpful and she sent me a notorized letter stating that the requested case file was purged and no information remained on file. I in turn sent the letter back to DOJ and they responded that the letter was insufficient and I should call my local assembly person. I have made several firearm purchase over the past years and have never had any problems till now. Any help would be appreciated.

There is a code section that requires the files to be retained only when there is a conviction... No conviction, no long term retention...

And generally felony case files have to be kept for 75 years. My guess is the court doesn't have the file in an automated system bu you could probably request copies of the actual paperwork in the physical file. Though you would have to pay a fee.

I know of a felony case that went invisible after about 25. For that reason always keep paperwork, bad or good.
