How do you X-fer a registered AW to a son or daughter? Is it just a straight Private Party x-fer? My local shop said no can do. I thought that it was legal to a son or daughter.

It generally can not be transferred to another party in California. Once out of state, it can not be re-imported. It might be able to be transferred to a LEO... otherwise, transfers within this state are a no-go. Sorry.

In otherwords, you're SOL on this.

AWs cannot be transferred to non LEO within the state. There is no exemption for sons/daughters.

You could remove the features that make it a SB-23 AW and then delist it with the DOJ. Then you can give it to your son/daughter. But they can never put it back into AW configuration.

Not if it is a Roberti-Roos or Kasler listed AW he cannot.

It goes with the owner into his/her grave.... to guard the grave... or if oneday the owner becomes a zombie, the zombie now have an AW to use.... against people who are thinking about using AWs against the zombie....

His title stated it was a SB-23 AW and I specifically stated what I wrote was for a SB-23 AW

A named AW cannot be inherited or transferred within CA.

There are certain 'edge' exceptions (LEO permit, and for folks that had their AWs jointly registered in same household) but for all practical purposes they don't exist for mere mortals.

Your probate executor has 90 days to dispose of the AW either thru the services of a dealer (ideally holding an AW permit) or moving it out of state to an inheritor there - or selling it to a licensed dealer there.

An "SB23" generic features AW can have sufficient evil features removed to render it into non-AW status (as described by 12276.1PC in combination with regulatory definitions in 11 CCR 5469) - and it can be retained/inherited as a normal firearm.

The ONLY thing you can do is to buy your son/daughter an OLL, then disassemble your AW, keep the named lower to yourself... and build your son/daughter a non-evil or fixed-mag CA-legal AR....

A retired Legislator attempted to bring this inheritance issue to light (http://www.leginfo.ca.gov/pub/05-06/bill/asm/ab_2101-2150/ab_2131_bill_20060418_amended_asm.pdf) a year ago.

Didn't go anywhere, but sure was fun to talk about.

One question that was asked was, if there is no way to take posession of your inherited estate, then is it a "taking" subjet to compensation?

Just for fun, there were several other exciting pieces to ponder. Maybe someday all or part of this bill can be resurrected.

We'll call it the Calguns.net partial deregulation and Department of Zombie Protection re-organization Act of 2008

Buy an OLL and teach the kids how to swap the parts over. When you die, they can cut the AW into three pieces and keep it on the fireplace mantle next to your ashes.

Speaking of lowers as decor. I placed a new set piece on top of my TV last night and when my wife noticed it, she wasn't too happy.

Don't you hate that gun dealers can skip the 10 day wait by simply writing in their bound book "For Owner's Personal Collection". :D

This is the single best reason I have ever heard for having my reg'd AWs buried with me.

Just buy an Off List Lower, a mag lock kit, and swap the parts in the lower from your registered AW to the new one. Oh and potentially get some 10round mags... as you cant use hi-capacity mags in a fixed mag lower.

Just take the listed gun to Evan's and have him perform one of his weld jobs on it, DOJ doesn't seem to have a problem with the listed guns he sells;)

Man Bill, I don't know if I would be advertising you only pack a 10mm. I would hope you at least had a 120mm gun. I guess as long as she is one of the "caliber doesn't matter types" it wouldn't matter.

Speaking of which, did you notice I put the picture of that lower in the TV? With the reflection being high off of that TV, had I not put the picture there, you would have seen more of me than you wanted.
