View Full Version : New Member, Active Duty Army in NC

Hello, I am currently active duty Army in North Carolina and own a couple M&P pistols, a 9mm and a .45. I have seen the CA compliant handgun list, and am familiar with the compliant versions of the guns I own, however I own the normal versions. I was a resident in California before I joined the Army 5 years ago, and my question is, can I keep these handguns when I come back to the state in a little less than a year? Any input is appreciated guys, however, if possible, please provide link for law/code saying yay or nay. Thank you.

Welcome to Calguns and thank you for serving. :patriot: Folks moving to CA can keep their non approved pistols as long as they do not violate CA AWB laws (threaded barrel, etc.). Any magazines you own that hold more than 10 rounds must be disassembled before entering the state and cannot be reassembled while in CA (unless common sense returns and that law is overturned.)

You will need to send in a registration form, and check for $19, for each pistol you bring with you, long guns do not require registration until 01/01/14.

So, if I am understanding correctly from SoCal Bob and other threads I've seen, as long as the guns are in compliance with AWB, and I replace my magazines with 10 rounders, then they will be legal to register? Is there anything else or does this basically cover it?

That covers it. The roster only applies to what a CA FFL can sell to the general population, LEOs are exempt and can buy non roster handguns. Non roster handguns can be sold in in Private Party Transactions (PPT), so you could sell yours at some point if you chose to do so. Some folks even stock up on non roster pistols before moving here with items like the Ruger SR1911 or LCP, Springfield 9mm 1911 or older S&W or Colt revolvers.

Off roster handguns can also be purchased as Single Shot Exempt (SSE). http://www.calguns.net/calgunforum/showthread.php?t=383692

Don't try to make any sense of CA laws, it will just make your head hurt. Do lots of reading here and you should know what to do (or not do) to keep out of trouble.
