If there is paperwork (read will ) listing you as the new owner all you need to do is go and get it or have it shipped to you.

Once you have it fill out the OpLaw form from the CA DOJ's website and send it in with your payment.

BTW Sorry for your lost.

Are you both CA residents? If so, he can hand it to you and you need to fill out the form mentioned above. If not, it must be shipped to a CA FFL and DROSed to you.

Yes, you need a HSC. Are you both CA residents? Are you 18 or over, if so, he can hand it to you.

Inheriting, after the owner has passed on, is simple - no FFL needed by either state or Federal law. Still must be at least 18, though.

Intrafamilial - grandparent to grandchild - can be simple, or a little complicated.

1) if you both live in CA, gparent gives handgun to 18+ gchild, gchild files oplaw form, done.

2) if interstate, has to go to CA FFL, and that means gchild must be 21.

In both (1) and (2), gchild needs the HSC.

If you are under or over 18 you need to have it shipped to me...... just joking.

I have two of my grandfathers guns and one of my wife's grandfathers guns and I wouldn't trade them for the world. Don't ever give them up. In glad your g-pa is still around.

You will not have any problems registering this gun. There was no law back then that any gun hand to be registered. One gun after it was bought from a dealer could have been legally sold many times and never seen a DROS.

I have to ask. If I received a 1960s semi auto AK back in 1995 which was givin to me by passed father. Would I have to sell it out of state? Could I keep it?

Have you checked the CA Semiauto Ban (AW) ID Flowchart linked at the top of each page of this forum? If the rifle is an "assault weapon" then it is illegal for you to possess, transport or sell within California, unless you registered it as an "assault weapon" with CalDOJ back in 2000. There's a chance that your particular model of AK was banned in California in 1989, six years before you inherited it. If so, then you wouldn't have been able to register it during the year 2000 registration period.

I believe the first semi-auto AK type rifles were imported into the U.S. in the early 1980's, so yours might not really be a 1960's era rifle.

Chances are that it was built into a semi auto much later than the 1960's. Whoever built it just used old (probably demilled) parts from the 60's.
