I have read and read, and I can't find what I'm looking for. There is a preowned off roster handgun being sold out of state by a dealer.... I really want it. Becauae it's "used", does that fall under the "exempt" rule even though it's not a PPT? It also has hi-caps, but I would tell the dealer to either break them down into parts (if willing), or just exclude them all together.

Your handgun will need to be Single Shot Exempted and the kits will need to stay kits. (SSE FAQ thread here (http://www.calguns.net/calgunforum/showthread.php?t=383692))

PPTs can only be done Face to Face, between two California residents.

It does not matter if the gun is new or used if it is off-roster.

You will also need to pay sales tax on your out of state purchase.
The tax + the SSE fee could prove to be a hefty amount so look around at your local dealers and you may be able to save a few dollars.

What kind of pistol is it?

It is a lightly used Baby Desert Eagle II 9mm 4.5" with polymer frame. It doesn't matter now.... I can't have it for $439 dammit.... lol

If it is a gift coming from your father/mother or child it is roster exempt. Any chance this is the case?

No, a dealer has it.

Now I'm curious what constitutes "consignment", or "return" if another dealer has it....... that's the language that threw me.....

Looking at this?

If it is Buds... and knowing Buds... they wouldn't have sent the gun since it's not on the roster and it has high-caps. They don't break down mags.

When dealing with roster/off-roster... unless both seller & buyer is under the same roof, its not a PPT. IMO.
