Upland settles with open carry weapon advocates over incident with police

UPLAND - The city has reached a settlement agreement with two open carry weapon advocates who sued the city after a confrontation with police officers.

Christopher Hacopian of Ontario and Scott Gibb of Adelanto filed a complaint in July in federal court accusing two Upland officers of violating their 1st, 2nd and 4th Amendment rights.

They also accused the officers of battery.

The city agreed to settle for $37,500 last week, City Manager Stephen Dunn said.

"It was going to be more costly to fight it," Dunn said.

Last July, Hacopian and Gibb, both openly carrying unloaded handguns, were passing out pamphlets about the 2nd Amendment in the Colonies Crossroads Shopping Center when officers Maurice Duran and Barry Belt approached them to check if their weapons were unloaded.

Carrying an unloaded handgun in plain sight was legal until January, when a bill signed by Gov. Jerry Brown made open carrying of handguns illegal.

It is still legal to openly carry unloaded rifles and shotguns.

Video and audio recordings of the incident show the men were detained, ordered to put their hands up and get on their knees for "officer safety."

They were then handcuffed and searched without consent.

Both men were eventually let go and not charged.

Duran and Belt were responding to a call made by a jewelry store employee stating there were two men with guns.

and Gibb, said the settlement is a victory for his clients.

"I do view it as a victory, though with all the lawyers (the city) hired that bill will probably be twice the settlement, and it could have settled for same amount last year if they had tried," he said.

Upland officers were later refreshed on the laws of open carry and how to handle those situations.
