View Full Version : Is this a "CA legal" muzzle brake?

Is the MSTN QC muzzle brake a muzzle brake as defined by CA law? See here:

It looks like a muzzle brake. It works like a muzzle brake. But could it be considered a flash hider? CA law seems to be especially murky about what exactly constitutes a "flash hider". I know the DOJ has said that muzzle brakes are OK, but have they stated any particular models they think are true "muzzle brakes" and not "flash hiders"? It seems to me that (as ridiculous as it sounds) just about ANYTHING could be a flash hider.

Yes, it has no expansion chamber.

I think you are pretty safe with that one. It's advertised as a brake and it has the small exit hole.

Looks like a brake to me, but would not spend $82 on one. Most brakes will do what this one is described to do.

Well, it says "Brake / Compensator" so it passes the stringent non existant test the CA-BOF uses.:rolleyes: Nowhere does it say "Flashhider" so it must be good.:confused: I keep a copy of the web page/instructions that says brake or compensator with my featureless OLLs. Can't hurt. Many here would say to not use anything but thread protectors, but I use compensators and feel comfortable with it. (However I am not a lawyer or one of those infamous '58 DAs', I just feel comfortable with brakes that say they are brakes and make no claim of being a flash hider).

One of our fellow CalGunners has one of those. He sat next to me on the line at the last Shoot-n-Q and everytime he fired the blast would blow my hair back.

He of course was non-plussed and was suprised cause he didn't hear of feel anything.

Apparently "QC" only applies to the shooter.

Well considering how badly you needed a haircut that day it's no wonder your hair was being blown back every time I fired.

Besides, I thought you compared it to a warm tropical breeze :D

It's also good practice. We're not playing golf here, so a shooter should learn to focus on his rifle and target and tune out distractions in order to make the shot.

Be glad I was having so much fun with the 6.8 that I didn't break out the SPRish build with the OPS Inc R32C brake.

I guess I should have asked, are there any concrete, legal definitions describing exactly what is and is not a muzzle brake/compensator. I know *we* all know that the MSTN brake is a brake, but if the DOJ wants to act like a bunch of a-holes, could they sucessfully claim this is a "flash hider"? Hell, it seems they could claim anything is a flash hider... in the absence of any definition, even a long barrel could be a "flash hider". Has the DOJ made any rulings (like the ATF did during the '94-'04 ban) on which muzzle devices are deemed to be non flash hiders?

Not to my knowledge.

But the DOJ could claim that the thing on the end of your muzzle is a chicken sandwich, or even a shuriken [gasp]. The problem is proving it.

In the absence of a state definition, I'm sure that the Federal one would suffice.

[watch this, Hoffmang and Bill are about to pillory me....I can feel it like the warm tropical breeze from Ted's rifle :o ]
