I am going to buy a Henry lever action rifle and I see that they come with the ability to hold more than 10 rounds.

Is this legal in California?

marlin 60's hold something like 15 rounds in the tube.

I bought a Henry Frontier lever action in March of this year at a gunshop in Temecula. DROSed and perfectly legal. Tube fed rifles are exempt from the 10 round magazine rule. I am commenting specifically on the Henry levers, not about pre-ban, post-ban removable magazine.

Tube fed = LEGAL.

I was reading the laws last night and remember reading about the tube fed magazine.

I didn't completely read through Bert's post and so I didn't have any problem with brreed1993's answer since I also was thinking the question was the one in the title. The second question Bert asked was: Is this legal in California? (referring to a tube-fed Henry lever-action .22). The answer to that, as several have pointed out, is "yes". Different question, different answer. This shows that we all must be careful when phrasing our posts and be sure we are asking consistent questions.

Completely understand about the tube fed situation.
I'm not clear on mag fed-yes or no on greater than ten round mags? Don't want to post a new thread.

tube fed .22's are fine. with detachable magazines, the 10 round limit is still in effect.

source: a remmington 552 speedmaster owner ( it holds 15 .22 short rounds)

Enjoy your Henry! I bought their lever action youth model several years ago. It'll hold 12 rounds in it's tube. Rifle shoots straight, and my son still enjoys shooting it (even though he's bigger than me now).

so what is it. I know if you had a high cap magazine before the ban you are allowed to use it. But what if you rebuild the original magazine to the point that there is no more of the original parts left is it still legal?

10 Round limit applies to any detatchable magazine regardless of the type of weapon it goes into. You can't even buy an 11 round mag for a bolt action...

gray area for a court at that point maybe.

spring /follower/screws should be unlimited
a housing should be only usable until true death,replacing the housing would constitute ---bad mojo , as it is the primary capacity determining component

Penal Code 16740
As used in this part, "large-capacity magazine" means any ammunition feeding device with the capacity to accept more than 10 rounds, but shall not be construed to include any of the following:
(a) A feeding device that has been permanently altered so that it cannot accommodate more than 10 rounds.
(b) A .22 caliber tube ammunition feeding device.
(c) A tubular magazine that is contained in a lever-action firearm.

The OP's real question was that he was going to buy a Henry lever action that holds more than 10 rounds and is it legal to own that firearm in California? Simple question, simple answer-YES.

He never mentioned removable magazines.
