Hey guys I was hoping you could help me out with a quick question. A couple years ago I was placed on a 72 hour hold for 5150 and told I could not own a firearm for five years. I was released and nothing came of it. I was wondering if you all know that prohibition applies to just California or if it is nationwide since I have moved out of state.

There is no nationwide 5 or 10 year bans. You either can or can't own guns with the Feds. CA has a bunch of temp bans. AFAIK, to get Federally banned for something like a 5150, you have to be declared mentally defective by a Judge or Doctor? The language is spelled out in the text of the 1968 Gun Control Act. You could also look at the list of questions on the 4473 Federal Gun Registration Form.

He may take testimony from a doctor; but a doctor doe not make an adjudication.

5150 is a California ban. 5250 would have become federal.

You can get a PFEC check done by the state if you are unsure if you are banned.

I would also closely check out the conditions of your 5150 hold.

Not all 5150 holds result in the five year prohibition.

Please refer to Welfare and Institutions Code section 8103(f) for the details.
