View Full Version : CA gun laws vs. (DC vs. Heller) & (McDonald vs Chicago)

I have to admit to being somewhat of a newcomer to this legal battle, and while I have searched the forums I may have missed it should this topic already have been discussed.

That being said, I am curious to know if there has been any movement to challenge the CA gun laws on the basis of the DC vs. Heller (2008) and McDonald vs. Chicago (2010) court cases? The rulings on these two cases tie the 2nd amendment into the protections of the 14th, meaning that the 2nd amendment applies to state and local governments as it does to the federal. There is even some precedence in our local legal region, with the 9th circuit court ruling that the 2nd amendment does apply to states in our region with Nordyke vs. King (2009).

Have I just missed whatís been going on? From the dates of those cases, I would have expected lawsuits to be popping up all through 2011 to challenge CAís laws. Obviously I canít speak for anyone else, but I certainly feel that my right to bear arms is infringed upon here in our golden state. Have the advocacy groups just been building cases, or was 2011 a bit of a furlough year?

Yes, there are an abundance of lawsuits in the works, using Heller/McDonald/Ezell/Etc as precedent cases. Chess pieces are being moved around the board. Everything just moves at an overwhelmingly slow pace.
