View Full Version : DELAYED ON SHOTGUN PURCHASE!

Hello everyone i'm looking for info on what I can do or if I can do anything at all. I bought a shotgun on Feb. 9th and the FFL guy told my I was ok in the system. I checked back on Feb. 13th and the guy said I was still ok. On Feb. 19th I went to pickup my shotgun and the guy told me I have had a "DELAY" put on me.
I had a possession of a firearm 12021 (D) PC back in 2000 and since then i've had it reduced to a misdemeanor and expunged. Before that I received a misdemeanor 626.10 (A) PC in 2000 for having a box cutter in my backpack at school for work after school. Come to find out last month, in 2000 a box cutter was not in the penal code they charged me with. In 2009 the law added a box cutter in the penal code. It has been over 11 years since all this has taken place.
If anyone one has advice constructive advice please help.

Dismissing with 1203.4PC is not enough, you also need 17PC.

Yes, I already did the 17b before the 1203.4PC. I'm going to call the FFL today to get a status update. I will also try to call the DOJ once again. Always hear the message to leave my name and number, still no call back.

Since you did the right forms it sounds like they simply have not updated the computers at the DOJ. You can do it yourself, though I'd bug the lawyer you hired in the first place if you did hire one. Then get a PFEC before you buy to be sure.

Welcome to calguns (and thanks for sharing your story). You will more than likely need to speak to the BOF/CADOJ to get the paperwork straightened out. Using an Attorney like Don Kilmer (http://www.dklawoffice.com/) here in SJ should get you on a straightforward, no-nonsense path to regaining your rights. Sounds like you’ve done most of it, it could just require some greasing of the wheels by the right person(s).

Well I have got through to the DOJ and spoke with a vary nice lady named Vicky. She explained that I need to send in a document that they've not received. I will hopefully be a proud owner of a firearm soon.
