View Full Version : Is it possible for my FIL to gift me 2 long guns from out of state?

I was wondering how my father in law can legally gift 2 shotguns to me, he is in Indiana. I went to a couple local dealers and they both told me it is not possible. That both guns would have to have been sold to me from a FFL dealer in Indiana then shipped to a FFL in California. I find this hard to believe. Any insight?

Nonsense. As long as they aren't AWs, he just ships them to a knowledgable FFL for transfer to you.

Find a FFL who will accept a shipment from a non-FFL and understands that these are NOT out of state SALES from a bussiness so, you don't need to pay use tax on them.

Huh? It is the same as buying the firearms from a private party, but in this case it is a gift. There is no sales tax due for a firearm from a private party (occasional sale, not from a business), see sales tax thread. In this case, a letter stating that it is a gift is the documentation that is needed.

There is no requirement for you to buy the firearms from an out of state FFL as others have said.
