View Full Version : Lever action rifle with 10+ round tube magazine legal in CA?

I was curious if either would be legal in CA. I already think that it is likely illegal in CA because the capacity is greater than 10+ but I could be wrong.

Lever action tube fed are exempt:
(c) (25) As used in this section, "large-capacity magazine" means any
ammunition feeding device with the capacity to accept more than 10
rounds, but shall not be construed to include any of the following:
(A) A feeding device that has been permanently altered so that it
cannot accommodate more than 10 rounds.
(B) A .22 caliber tube ammunition feeding device.
(C) A tubular magazine that is contained in a lever-action
firearm.

I just bought a Marlin 1894 in 32 H & R Magnum - holds 10 rounds. I'm guessing it holds about 18 32 S & W shorts.

Does this apply to shotguns? Like if there was a pump action shotgun which could hold 10+ shells in the tube magazine?

A pump-action shotgun is not exempt, lever-action is the key, unless it's a .22 caliber.
Although, I believe tubular magazine capacity is based on the largest sized shell the gun can fire. Therefore an 8 shot Mossberg could probably fit a dozen mini shells and still be legal.

Yes, since it's a lever action firearm, the 10 round magazine limit does not apply.

Or a detachable tube magazine. I've seen some take down conversions that are almost there already.

Has anyone seen those lever action AR-15's? Is it possible to have one of those rifles with a 30 round magazine? Better yet, a drum. :p
