There's no way a reg period can open now (unless court ordered due to formal regulatory changes actually occuring).
DOJ just did a "welcome to 2007, these are the new gun laws" update on their webpage.

jemmadux, you really need to post links. I think he might be talking about the "2007 Dangerous Weapons Control Law" (http://ag.ca.gov/firearms/dwcl/index.php) on the right in the latest additions. I really hope he isn't talking about that because all that is is the Penal Code sections that deal with "dangerous weapons control laws".

I talked to DOJ yesterday and they had a whole new attitude about everything tell me that the OLL where perfectly legal to buy so feel free to sell them:confused: , never heard that before yesterday from them.

12275.5. (a) The Legislature hereby finds and declares that the proliferation and use of assault weapons poses a threat to the health, safety, and security of all citizens of this state. The Legislature has restricted the assault weapons specified in Section 12276 based upon finding that each firearm has such a high rate of fire and capacity for firepower that its function as a legitimate sports or recreational firearm is substantially outweighed by the danger that it can be used to kill and injure human beings. It is the intent of the Legislature in enacting this chapter to place restrictions on the use of assault weapons and to establish a registration and permit procedure for their lawful sale and possession. It is not, however, the intent of the Legislature by this chapter to place restrictions on the use of those weapons which are primarily designed and intended for hunting, target practice, or other legitimate sports or recreational activities.
(b) The Legislature hereby finds and declares that the proliferation and use of .50 BMG rifles, as defined in Section 12278, poses a clear and present terrorist threat to the health, safety, and security of all residents of, and visitors to, this state, based upon findings that those firearms have such a high capacity for long distance and highly destructive firepower that they pose an unacceptable risk to the death and serious injury of human beings, destruction or serious damage of vital public and private buildings, civilian, police and military vehicles, power generation and transmission facilities, petrochemical production and storage facilities, and transportation infrastructure. It is the intent of the Legislature in enacting this chapter to place restrictions on the use of these rifles and to establish a registration and permit procedure for their lawful sale and possession.

Ok I skimmed the new link on DOJ and I am not sure but in section 12276.1 the wording appears to have changed and removed the "must use a tool" blurb in regards to capacity to except. or was that somewhere else?

I am not over reacting. I asked CWS to look at it also and see what they think. I am reading this and it looks like a bunch of stuff has changed and I have no idea what it going on. I want people that know a little tro look at it and explain.
(2) Chapter 3.5 (commencing with Section 11340) of Division 3 of Title 2 of the Government Code, pertaining to the adoption of rules and regulations, shall not apply to any list of assault weapons promulgated pursuant to this section.
(c) The Attorney General shall adopt those rules and regulations that may be necessary or proper to carry out the purposes and intent of this chapter.
This sounds like they can still list. And like I already said, I talked to DOJ yesterday and now they are saying everything is fine with them to sell and so on. So again, can someone please explain what has changed and try to figure this out?

Supposedly ARMS just got a big military contract and it might be a while before they get them back to us again. I ordered some from Stag and they said they might have a few. So in a week or in two months. I don't know.

James, all of those links are to penal code. THE DOJ DOES NOT HAVE THE AUTHORITY TO CHANGE PENAL CODE! They don't have the authority to change anything. Basically they made a nifty little section for making it easy to read the rules. Nothing has changed. Zip, zilch, nada.

The two quotes you just got are both correct, but the first one is no longer relevant (it explains HOW the DoJ shall do something that with 2728 they can no longer do), and the second one is not pertinent (yes, they can propose regulation, but they have not regulated recently). You should know that.
Either this is (a) an elaborate hoax, or (b) it is a joke that's starting to be in bad taste, or (c) you should sober up, or (d) you need real help from professionals. I'm hoping the real cause is (c); and I hope that it is not (d).
OK, now restarting my usual humor: Ordering something from 10% and CWS is always a good idea. So far this week, I have only ordered stuff from Natchez, but Friday is still young.

All right, this is just core of AB2728...
12276.5.
(a) The Attorney General shall prepare a description for identification purposes, including a picture or diagram, of each assault weapon listed in Section 12276, and any firearm declared to be an assault weapon pursuant to this section, and shall distribute the description to all law enforcement agencies responsible for enforcement of this chapter. Those law enforcement agencies shall make the description available to all agency personnel.
(b) (1) Until January 1, 2007, the Attorney General shall promulgate a list that specifies all firearms designated as assault weapons in Section 12276 or declared to be assault weapons pursuant to this section. The Attorney General shall file that list with the Secretary of State for publication in the California Code of Regulations. Any declaration that a specified firearm is an assault weapon shall be implemented by the Attorney General who, within 90 days, shall promulgate an amended list which shall include the specified firearm declared to be an assault weapon. The Attorney General shall file the amended list with the Secretary of State for publication in the California Code of Regulations. Any firearm declared to be an assault weapon prior to January 1, 2007, shall remain on the list filed with the Secretary fo State.

No, the ability to list is gone. A lot of 12276.5 stuff walked away w/2728.
The stuff you see is just administrivia. What if there was a misprint or typo on a list? They could update it without going thru the OAL. That was the case before 2728, this text is just a hangover. The ability to list - by either updating the Kasler list of AR/AK guns, or requesting a court to ban a new non-AR/non-AK gun thru a 12276.5PC 'add on' petition - IS GONE, as no enabling law for this is there anymore. Notice how much shorter 12276.5 is than before, also :)
As far as (c) above, about AG adopting rules & regs, sure - they can determine the color of paper when they send out copies of existing registrations. Or, say, they would be allowed to set up a website or 800# to check on registration status.
THEY CAN'T DO ANYTHING ELSE, AS THAT GOES BEYOND THE SCOPE OF ACTUAL STATUTORY LAW. Regulatory law cannot exceed statuory law.
That's why the new regulatory definition hasn't taken hold - because of side effects, and because they failed to follow OAL procedure if they had submitted something in November.

It neither, I was reading someing and wanted a opinion. I put a post up and most times I get idiots responding. Now I put something up and say read this now and see people pay attention. Like I said, DOJ has a new attitude on this whole thing. And if you don't like it treelogger, then don't read what I write.
