After having to deal with all the crap in reguards to a wrongly filed restraining order now I have to wait even longer to get my guns back because I need a court order. Amazing they make me give them up within 24 hours of being served, but it takes much longer to get them back. Thankfully I did not loose anything. But needless to say it cost me over $5,000 to beat it. All I have to say about that crazy woman is that she needs mental help and a lot of it.

Congrats on beating an unjust charge, but my sympathies on the cost of defending yourself.

Been their. Done that. Watch what you say or do around her because she will try it again. I found that recording everything works well. Till she get the point. Good luck:)

You would have to prove that she did it with mallice. Just because she made a report and he beat the charges does not make her civally liable.

i dunno. in this state you can sue homeowners for medical care for wounds incurred while BREAKING INTO THEIR HOUSE.....

Don't forget about the LEGR if you need one, the Law Enforcement Gun Release, a form that you fill out and send with fee to DOJ so they can check you out and make sure you are eligible to possess weapons. The police won't give them to you without this, supposedly.
I filled out the form and sent it on on December 15 to retrieve the pistol that was stolen and recovered by the police. I sent a copy of the police report showing it was sotlen which entitles me to waive the fee. I received the clearance in the mail yesterday, so it took about 20 days, less than the 30 allowed.

In 2001, my mom's house was burglarized and my P228 and Phoenix HP-22 were taken. The cops caught the burglars two days later and recovered the HP-22 (I wish it'd been the other way around... :( ) along with a bunch of other stuff. We went to the police station and got our property back, gun included.
I'm sure it helped that my mom worked for the city, knew most of the cops, and was good friends with the officer who was in the lead on the case ;)

Now, SDPD/SDSO, etc can't do that without the LEGR, Form 119 filed with DOJ, and clearance from DOJ regarding your eligibility to possess a firearm. They(PD/SO) may not know that yet, but that is what DOJ regs say.
