After spending a year and a half in jail Elliot Mayfield was found not-guilty for shooting an attacker at a bus stop. He tried to avoid the attacker and didn't shoot despite being punched and threatened. He finally shot the attacker when one of his minor daughters became involved in the fight and he feared for her safety.

The case should, on the face of it, never been brought. They even had video of the lead up showing that the deceased instigated it and would not back off. Clearly the judge thought so too, so why did they ever prosecute? Is Illinois that far removed from sanity?

So, if he had waited until after his daughter had been killed, would he have been given less jail time? A year and a half for VERY reluctantly defending one's children? Former drug counselor? It sounds like he is an upstanding member of the community rather than a troublemaker. I don't get the overzealous prosecution.

A resounding yes.

Good on him for doing what was needed to protect his daughter, but its a darn shame he had to pay so dearly for it with his freedom for a year and a half.

Amazing he was not charged with carry of the weapon. At least this judge gets it. Now only if the Chicago elite would allow citizens to take care of themselves . . .

The ISRA will probably be contacting this gentleman.

Guess "Cook County" didn't want this going as a "carry case" because it seems strange to me that he wasn't persecuted for unlawful carry of a loaded gun.

I am under the impression that unless it can be shown to have been a frivolous prosecution, or one based on manufactured but untrue charges then the poor devil gets nada.

I think in this case he could probably show that it was indeed a frivolous prosecution. I obviously don't know every detail but from what I see he was afraid for his life. Everyone has the right to defend themselves. Apparently in Chicago though, they would rather see someone be a victim. :rolleyes:

I find this policy to be absurd, and probably the very reason for DAs taking questionable cases that far in the first place. If you are a lawyer who handles a client's case poorly for 1 1/2 years, thus passing a statute of limitations and preventing the client from recovering losses, you can-and most likely WILL-be sued.

If you are a "public servant" who takes an obvious dog of a case, yet refuse to release your teeth from the case just hoping to make a name/statement, and that steadfast refusal to do the reasonable thing costs some poor guy a year and a half of his life/time with his family/lost wages/legal fees that he will NEVER be able to recover from-you are held harmless.

I can see where allowing cases might theoretically be an issue-cases where juries try to send a message such as with OJ Simpson-opening the state to frivolous cases, but it is ludicrous to have absolutely no recourse except for the very most heinous of prosecutions.

Unless there is far more to this case than is in the article, this prosecutor and the city that tried this man should pay ALL damages.

This is the kind of absolute garbage we get when we tolerate illegal voting in Illinois, with Mayors like the psychotic Daley or worse yet the scumbag known as Rahm Emmanuel. I find it absolutely* daunting* that someone spends a year and a half in jail for merely defending themselves when shooting in self defense.

This is the exact kind of travesty the framers were running away from when they left Britain, and why the 2nd amendment was so close to the top right after freedom of speech.

Back then, we had the monarchy and its sycophants.
Today, we have a liberal socialist president , a community and culture scant on unity and values, and minority voters focusing on issues like gay marriage and illegal immigration while increasing taxation as their hottest topics.

Don't spend money on defense! Spend it on *me* cuz I want Barack Obama to pay mah rent! And if he wants to take our guns away, its ok cuz he's making the hood safer!

Ugh.

"Community organizers" in Chicago like Barack Obama who allege to take care of the disadvantaged are nothing more than socialist elitists sucking on the teat of the citizens. They're about payoffs, enriching themselves, taking kickbacks, and pulling at the heartstrings of the poor and weak.

Since IL doesn't have any legal carry right now, this guy still could be a carry case plaintiff(not sure if he could be added to the current lawsuits). Obviously if he was nailed on carrying, there would be much more urgency to the lawsuit.

He was never charged with violating the UUW/Ag UUW (Unlawful Use of a Weapon) statute. The State tried to prosecute on the charge of attempted murder.

The State could still bring charges for violating the UUW/Ag UUW statute, but I highly doubt they will at this point in time due to the ongoing lawsuits.

Even if they tried to the time he spent in jail on the original charges would probably be as much or more than he would be sentenced to for UUW.
