I read his complaint. He is both a licensed attorney and employed as a licensed bail agent? That is a strange combination indeed.

Well I hope he wins, but I can't say that I think he has the best approach.

This confusion is due to the poor way it is written. The Plaintiff is Thomson and Birdt is the attorney but the use of the first person in the complaint makes it appear as if Birdt is the Plaintiff.

Do judges ever toss cases based on spelling errors, confusing briefs etc...? I read the Upland filings and he uses the wrong name for one of the cops half way through.

Will be interesting to see what happens with AB144 in August. if it passes it would essentially moot Richards & Peruta and send them back to the starting position. Looks like Portantino is in such a hated place though that it isnt likely to pass and so we wait...

It's telling that he doesn't understand that AB-144 has no negative impact on Richards v. Prieto and Peruta.

Can he even sue Torrance and the LASD in the same complaint? Aren't there separate actions because they are separate applications/events?

Is it common to review what the plaintiff believes the defendant's legal argument in the "legal background" section even before the defendants have filed anything? "Defendants justify their position with..."

I think that is because they have the video of the event right?
