View Full Version : Borrow Pistol with hi-Cap Mag

Okay,

I think this is illegal. I wanted to borrow a friends SIG 226 to allow someone else to shoot at a range with me who is interested in buying one for home protection. The guy who owns the pistol has owned it for 12 maybe 14 years. So it has the high-capacity magazines. He hardly fires it all that much, and doesnt think too much about it because he doesnt follow the laws and he knows that they are not illegal for him to own because he is the original owner of the gun.

But if I was to borrow it, I gather Im not allowed to borrow the magazines. Which would mean I would have to buy 10 round mags for a gun I was going to borrow for a few days to show off to someone who wants to try it before buying. Or get my buddy to buy them, which Im sure he's not interested in doing.

Probably just get the range gun.

But its an interesting questions. Can your friend loan you his pistol that has only high capacity mags with the mags included. I think not. What do you guys think?

I believe that the law is specific in saying that the loan of high cap magazines is not ok, so letting them out of the imidiate controll of the owner is probably not a good idea.

just bring your buddy who owns the gun along to the range, then it should be ok.

One can loan high capacity magazines for limited durations where the original owner stays in the vicinity and not more.


(b) Subdivision (a) does not apply to any of the following:

(22) The loan of a lawfully possessed large-capacity magazine between two individuals if all of the following conditions are met:

(A) The person being loaned the large-capacity magazine is not prohibited by Section 12021, 12021.1, or 12101 of this code or Section 8100 or 8103 of the Welfare and Institutions Code from possessing firearms or ammunition.

(B) The loan of the large-capacity magazine occurs at a place or location where the possession of the large-capacity magazine is not otherwise prohibited and the person who lends the large-capacity magazine remains in the accessible vicinity of the person to whom the large-capacity magazine is loaned.

He can lend you the gun, as per the infrequent loan provisions in PC. (Under 30 days, etc.)

He cannot lend you the hicaps unless you are in his physical presence.

[Oh, if you are to borrow just the handgun you must have a current HSC card.]

I have my HSC, for some reason this made me laugh hard. The laws are getting rediculous.
