View Full Version : Proposed Reg's... What happens if????

Ok I have been trying to stay on top of things but I still have one question. DOJ has proposed new regulations, but in order for them to become effective they need to go through the OAL, Correct? But what happens if they dont get approved by the OAL, by Jan 1st, with all the other reg's going into place? Does the proposal die?

They have not even been submitted to the OAL for all we know.

What are the other Reg.s going into affect?

Any that affect current gun laws?

CA DOJ proposed new Administrative Law Rules that they wanted to address magazine fix kits. However, those rules are awfully deficient under the OAL Rules.

DOJ can do three things:
1. Make changes based on the last round of feedback from all of us and resubmit them to all of us for public comment.
2. Attempt to move forward by submitting them to the OAL, who is likely to reject them in current form.
3. Do nothing. DOJ has up to 1 year, from I believe the initial date of the proposal but I need to look again, to submit them to the OAL - otherwise they have to start the process all over again.

My supposition is that we'll see no action on them for a while but I have no additional information to support that supposition.

You will see them do something with these proposed regs. Since their ability to promulgate a list of series weapons or file a court "add-on motion" will be stripped from them, there is nothing else they may do. They have painted themselves in a proverbial corner, and expect their last acts to be in desperation.

That is what I am looking forward to. Maybe Brown's camp will make this whole thing just go away.
