View Full Version : a ? on being us citizen and giving oll as present

Two questions.

1. Do you have to be a US citizen to buy a oll and build a legal ar15.

2. Can I give a OLL to my brother as a present. Do I have to give it to a ffl and redo a dross for my brother.

Since an OLL is considered a rifle. You can give your OLL to your mom or dad, who can then give it to your brother, without going through an FFL. But if you give it directly to your brother then you are supposed to go through an FFL. Others will chime in on this, but im pretty sure I have this correct.

There is no difference between an OLL and any other rifle. If you are eligible to buy a long gun in California (Green card, correct visa, what have you) then you can buy an OLL.

You can give it as a present but you have to do a private party transfer at an FFL to be legal. One option is to buy two and bring your brother to DROS with you at the transfer FFL.

No, you don't have to be a citizen. However, if you're not a permanent resident either, you really need to read up on the laws so you don't commit a federal offense.

My wife bought a pistol about 2 years before she was granted citizenship, of course she had been a permanent resident since she was a month old. All they needed was her green card in addition to all the usual doc's.
