View Full Version : Two-Part Question: SKS + gun in car

1. What part of the SKS is considered the firearm (e.g., like the AK or AR lowers).

2. If I remove whatever part that is (along w/ any ammo & mags to be on the safe side), can I legally drive around with the resulting "part kit" because it isn't considered a gun?

It seems like as long as I left the stuff from Q #2 somewhere besides on my person or in the vehicle, it can't even be construed as constructive possession, as the crucial parts wouldn't be in my possession.

As to why, because I can. [Sorry, that line was too good to pass up].

1. The part with the serial number on it.

2. You can legally drive around with the gun between the front seats fully assembled with 5 stripper clips in the cupholder.

You can legally drive around with the gun on your lap and the stripper clips in your shirt pocket, or free hand...

Let me rephrase the last part since I worded it poorly:

If I removed the ammo and the part w/ the serial number, would I be fine driving/parking in areas where firearms are illegal. Say within 1000 yards of a school (pass one every time on the way to Big 5).

Though as the others said you can have a fully assembled SKS with ammo near by in the car and I am not sure why it is of relevance, here is a list of the parts easily removable from an SKS that someone could have that would not be considered part of the firearm: trigger group, mag, stock, gas tube, gas piston, bolt, bolt carrier, receiver cover, and bayo is equipped with one. As stated before the part with the serial # is the receiver. There are a couple other parts that could be removed but are more difficult these include the sights, the remaining gas system parts, and the barrel which would needed to be removed/put on by a gunsmith. Also you say “mags” in plural. Keep in mind that any SKS with detachable mags in CA is and AW. They have to have the 10 round fixed mag that they originally came with.

+1 My truck gun is a Norinco Paratrooper with a red dot sight. Great for coyotes.:D
