I know a true B*S#@&! of a surgeon who was given a "going away present" from our local OR staff-a case of this:

It would seem that not everyone is involved in censoring product names, so Gura may just have a case. At least there is precedence.

The beer in question is also available in CA. I would suggest everyone go out and buy up what you can. Nothing like letting people know that we support them. Voting with our pocketbooks works in both directions you know.

I have been brewing my own beer, off and on, for 18 years and I also really like craft beer.

All of Flying Dogs beers are good and I'm sure if you have a taste for good beer you'll enjoy a couple of 6 packs.

"Evil" is a Cab, "B*tch" is a Grenache both out of Australia.

As actually applied, beer should be regulated by ingredients and by alcohol content.

A riff on MLK : "I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin, but by the content of their character."

I wonder how long Alan has had that in his head, waiting to use it in a case filing.

Too bad. I hope the best for Flying Dog, they make a good brew (albeit an expensive one even for a craft brewery).

Arrogant Bastard is great too, as are the rest of their bastard beers. So awesome.

Actually I saw a few days ago an article about how some states are going to reduce taxes on cigs. Most likely because the health care industry is losing money on less people with lung cancer and the state is losing money from less cig sales.

not to threadjack BUT....
ABA is a fave of mine, as well as their (Stone's) IPA and several other brews. the Double Bastard is a bit much, but when the time is right, its great too.
Stone is great brewery, a model green business, and if you're ever in Escondido, their Bistro (http://www.stoneworldbistro.com/) is well worth a visit. The food and beer are top-notch. :cheers2:

Knowing HST was fond of big bore revolvers, when he died I went looking for an engraver to embellish my .475 Linebaugh BFR with Steadman inspired Gonzo engravings but I could not find one that would do anything more controversial than an animal portrait.

I hope that Flying Dog Brewery and Alan Gura prevail.

I seem to recall another beer label related case that succeeded involving Bad Frog Brewery. Aha, here it is! http://law.justia.com/cases/federal/appellate-courts/F3/134/87/561911/ Bad Frog won on 1st Amendment grounds.


One very useful thing we get from this case is that the hundreds of thousands of us who would like to buy Mr. Gura a beer if we get the occasion to do so now have an official brand to buy, making the decision much easier. Perhaps Flying Dog might even make a special brew in honor of him for that purpose?

I'm not even sure I understand that quote.

I think that he means that you can regulate the alcohol content, physical conditions of its brewing with respect to safety, validity of what is printed on the label (can't lie about ingredients for example), etc., but you can't regulate the thoughts that are behind what is printed on the label.

Lagunitas brewery is pretty well known for their affection of marijuana. They once admitted a label to TTB for "Kronik" beer. My understanding is that they got approval but the son of one of the TTB folks saw the label incat a stack of paperwork and let the cart out of the bag. Once they knew what Kronik meant the TTB pulled approval.

Now the beer is known as "Censored."

That's the way I heard it anyway.

Something I remembered from my law classes, could be relevant, Bad Frog Brewery V. New York State Liquor Authority

They had labels with a frog flipping the middle finger. NYSLA said No, then the Brewery said, "see you in court suckas". Appelate court overturned the injunction.

I think the part that bugs me the most about this one is... it's not obscene. It's correct usage of terminology. It's not used as a pejorative, but rather the correct terminology for a female dog.

Can you get me a discounted growler (or two...)? I intend to make the pilgrimage down there to refill it (or them) quite often eventually. Its' only a 100 mile drive for me, so it's an awesome afternoon trip to get whatever seasonal is available (or Arrogant if it's not).
